RESOLUTION NO. ~9-48 AUTHORIZING EXECUTION OF A DEED <br />GRANTING REAL PROPERTY NUMBERED 1053 '~U~ST SIXTH STREET, <br />SANTA AMA, CALIFORNIA, TO CHARLES SRIITH, AUTHORIZING <br />PA~NT OF CASH CONSIDERATION AND DECLARING ACCEPTANCE <br />OF ~d~ OPTION <br /> <br /> WHEREAS, heretofore theCity of Santa Ana filed an action <br /> <br />in eminent domain, Case No. 72569, and after extensive negotiation <br />a tentative agreement was reached for the acquisition of property <br />in which the defendant, Qh_a~_m_~ had an interest; the agree- <br />ment was approved by the City Council and the ~atter has now been <br />placed in escrow at the Orange County Title Company; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That in consideration of <br />Charles Smith delivering to the City a good and sufficient deed <br />conveying his undivided one-third interest in that certain property <br />described as: <br /> <br /> Lot i of the north part of the Greenleaf Tract, as per <br /> msp thereof recorded in Book 2~, Page 49, Miscellaneous <br /> Records of Los Angeles County, California~ <br /> <br />and executing and delivering to the City an option to repurchase <br />within one year after the death of said Charles Smith that certain <br />real property hereinbelow described, for an amount of ~;~,~00.00, <br />the City agrees to execute and deliver to said Charles Smith a deed <br />to that real property in the City of Santa Ar~, County of Orange, <br />State of California, known and numbered as 10~3 ~est Sixth Street, <br />and described as: <br /> <br /> The easterly 13-1/2 feet of Lot ll and the westerly 28 <br /> feet of Lot l0 o Gildmacher's Addition, as per map re- <br /> corded in Book 23, Page 37 of ~iscellaneous Records of <br /> Los Angeles County, California, <br /> <br />and the .~ayor and the Clerk of the Council are hereby authorized <br />and directed to execute on behalf of the City a grant deed to said <br />property and to deliver the sa~e through escrow heretofore opened <br />at the Orange Uounty Title Company. As a further consideration <br />for said option the City agrees to pay to said Charles Smith the <br />sum of ~975.00 tarough said escrow, and the Mayor and Clerk of <br />the Council are authorized to accept the option on behalf of the <br /> <br /> <br />
