.Ana, for the construction of said improvement, according to the plans and specifications set forth in said bid and hereby adopted as the plans and specifications for said improvement. That said contract shall further provide that the contractor furnish a bond in the amount of fifty percent of said con- tract price for faithful performance of said contract, and a further bond of fifty percent of the contract price to cover labor and materials. That said contract shall also provide that twenty-five percent of the consideration hereinbefore mentioned shall be retained by the City of Santa Aha for a period of eight months subsequent to the date of completion, at which time such balance shall be paid to the contract or his assigns. That on account of the emergency which exists for the awarding of this contract, and the completion of said improvement before the summer of 19~8 is ended, snd the dmmage which would be caused the City of Santa Aha in the event said improvement is not completed within the time hereinbefore mentioned, said contract shall further provide that the con- tractor shall pay to the City of Santa Aha as liquidated damages the sum of One Hundred Dollars ($1OO. O0) for each and every day that shall elapse subsequent to the completion date hereinbefore mentioned to the date when said improvement has been completed, the same to be deducted by the City of Santa Ana, if any of said liquidated damages shall become due, from the final payment due the contractor, under the terms of said contract, provided that such failure to complete said improvement within the time hereinbefore specified is not caused through an Act of God or necessary to be employed in the improvement. strikes affecting the labor construction of said I hereby certify that the foregoing Resolution was duly and regularly introduced, passed and adopted by the City Council of the City of Santa Aha, at an adjourned regular meeting thereof held on the 24th day of February, 1928, by the following vote, to-wit: AYES, TRUSTEES: J.L.NcBride, W.J.Kelly, W.G.Knox, Stanley E.
