RESOLUTION ORDERING WORK

<br /> WBF~REAS, the City Council of the City of Santa Aha, on the 26th day of
<br /> May, 1950, passed its Resolution of Intention No. 2199, to order the hereinafter
<br /> described work to be done and improvement to be made in, on and along Birch Street
<br /> between Fairview Avenue ~d the Northerly line of T~act Ncc 352, which Resolution
<br /> of Intention No. 2199 was duly and legally published twice in the Santa A~a Daily
<br /> Evening Register, a daily newspaper published and circulated in the City of Santa
<br /> Aha, all as required by law, as appears from the affidavit of W. Lee Millis,
<br /> principal clerk of the printers and publishers of said daily newspaper, and which
<br /> affidavit was filed in the office of the Clerk of the City of Santa Aha, on the
<br /> 29th day of May, 1930; and
<br /> WHEREAS, after the'passag& and adoption of said'Resolution of'Intention
<br /> No. 2199, the Street Superintendent of the City of Santa Aha conspicuously posted
<br /> along the line of the contemplated work and improvement, at not more than three
<br /> hundred' (300) feet in distance apart, and 14 in all, notices of the passage of sai~
<br /> Res~lmtian cf Intention, headed, NOTICE OF IMPROVEMENT, in the m~e~, 'form and
<br /> substance as required by law, and the work being chargeable upon a district, also
<br /> conspicuously posted copies of said notice along all of the open streets within
<br /> such district at not more than three hundred (300) feet in distance apart, as
<br /> appears from the affidavit cf C. L. Jeraken, said Street Superintendent, who
<br /> personally posted said notice of improvement; and
<br />
<br /> WHEREAS, the Street Superintendent of the City of Santa Arm, commenced
<br /> to post said notices on the 4th day of June, 1930, and fully completed the posting
<br /> thereof on the 4th day of June, 19~0, more than ten (10) days before the date set
<br /> for hearing protests or objections to the proposed work and improvement, all as
<br /> appears from the affidavit of C. L. Jenken, Street Superintendent of the City of
<br /> Santa Aha, filed in the office of the Clerk of said City on the 4th day ef June,
<br /> 1950, and now on file therein; and
<br />
<br /> W~EREAS, the City Council of the City of Santa Aha was duly and regularl
<br />in session at the Council Chamber thereof at the hour of ?:30 ofclock P.M. on
<br />Monday, the 16th day of June, 1930, bein~ the time, hour and placelnamed in the
<br />Resolution of Intention and Notice of Improvement, when and where any and all
<br />persons having any objections to the proposed work or improvement may appear
<br />before the City Council and show cause why said proposed work should not be carrie.
<br />out in accordance with said Resolution of Intention No. 2199; and
<br />
<br /> WNE~REAS, all protests or objections presented having been disposed of,
<br />overruled and denied, in time, manner and form as required by law, and the City
<br />Council of the City of Santa Aha having acquired Jurisdiction to order the pro-
<br />posed work done and improvement made;
<br />
<br /> IT IS HEREBY RESOLVED, by the City Council of the City of Santa Aha that
<br />the public interest and convenience requires the work done and improvement made
<br />particularly set forth and described in Resolution of Intention No. 2199, which is
<br />dated the 26th day of May, 1930, on file in the office of the Clerk of said City
<br />and hereby referred to and made a part hereof, and the City Council of the City
<br />
