RESOLUTION NO. 2339 <br /> <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> SANTA ANA, CALIFORNIA, RELATING TO THE ISSUE OF <br /> STREET IMPROVEMENT BONDS PURSUANT TO RESOLUTION <br /> OF INTE~TION NO. 2316, DETERMINING THE AMOUNT <br /> OF UNPAID ASSESSMENTS, PRESCRIBING THE DENOMINATION <br /> OF SUCH BONDS, AND PROVIDING FOR THEIR ISSUANCE IN <br /> ANNUAL SERIES: <br /> <br /> WHEREAS, pursuant to Statute, notice of the filing of list of unpaid <br />assessments was duly given in the manner and form required by law, that the <br />warrant, assessment and diagram was recorded on the 7th day of June, 1932, for the <br />work and improvement made by Kavocevich and Price, under that certain contract <br />awarded to them on the 21st day of December, 1931, upon portions of Seventeenth <br />Street and Eucalyptus Street, as set forth in Resolution of Intention No. 2316; <br />and that said warrant, assessment and diagram were returned to the Street Super- <br />intendent of said City, together with a written statement of all payments receive <br />upon the said assessment; and after the full expiration of thirty (30) days after <br />the date of recording of said warrant the said Street Superintendent duly made and <br />filed with the City Clerk of said City of Santa Ana, a complete list of all assess <br />merits unpaid upon said assessment, which list is now on file in the office of the <br />City Clerk of said City. Now, upon evidence shown, this City Council determines <br />that the assessments therein mentioned were then unpaid, the total aggregate <br />thereof being the sum of Sixteen Thousand, Three Hundred Thirty-eight and ll/lO0 <br />Dollars ($16,338.11), and that there has been paid since the filing of the list <br />of unpaid assessments by the Street Superintendent the following assessments, <br />to-wit: Assessment No. 39 for $8.97; Assessment No. 40 for ~$13.83; Assessment No. <br />41 for $13.84, Assessment No. 42 for ,~760.62, Assessment No. 42-A for $87.21; <br />Assessment No. 43 for ~11.59, Assessment No. 44 for $17.27; Assessment No. 45 for <br />$17.27; Assessment No. 46 for $766.73; ~ssessment No. 130 for $236.60 and Assess- <br />ment No. 135 for $35.93, and that there now remains unpaid the sum of Fourteen <br />Thousand, Three Hundred Sixty-eight and 25/100 Dollars (~14,368.25) upon the <br />assessments shown upon said list. <br /> <br /> Reference is hereby made to Resolution of Intention No. 2316, of the <br />City Council of the City of Santa Ana, passed on the 3rd day of August, 1931, for <br />a complete description of the work herein mentioned, and to the list of unpaid <br />assessments filed as above stated for the assessments unpaid; and <br /> <br /> WHEREAS, interested persons were notified in the manner required by law <br />to appear before the City Council in the Council Chamber of the City Hall of said <br />City at the hour of 7:30 P.M., on Monday, the 18th day of July, 1932, and show <br />cause why bonds should not be issued upon the security of the unpaid assessments <br />shown on the Street Superintendent's list; and <br /> <br /> WHEREAS, notice was duly given in the manner and form required by law, <br />that serial bonds to represent unpaid assessments bearing interest at the rate of <br />six per cent per annum will be issued hereunder in the manner provided in the <br />"Improvement Bond Act of 1915", the last installment of which bonds shall mature <br />Nine (9) years from the 2nd day of July next succeeding ten (10) months from their <br />date, and all interested persons having appeared before this City Council and <br />having been given a full opportunity to show cause why bonds should not be issued <br />upon the security of the unpaid assessments shown on said list, and all objections <br /> <br /> <br />
