<br />RESOLUTION AUTHORIZING D~:~

<br />IN THE MATTER OF THE PETITION OF J.C.
<br />METZGAR AND BELLE H. METZGAR FOR D~:~,
<br />
<br /> J. C. Metzgar and Belle H. Metzgar, having filed their petition praying for
<br />an order authorizing the execution and delivery of a deed from the City of Santa Aha,
<br />re-conveying to said petitioners, as Joint tsnants, that certain land in the City of
<br />Santa Ana, County of Orange, State of California, described as follows:
<br />
<br />The Easterly 12 feet of Lots Two (2), Three (3), Four
<br />Seven (V) and Eight (8) of Tract No. 925, as per map
<br />thereof recorded in Book 29, at'page lA, of Miscellaneous
<br />Maps, records of said Orange County,
<br />
<br />which land was conveyed to the City of Santa Aha for street purposes by deed dated
<br />November 8, 1930, and recorded in Book A38, at page 1~9, of Official Records, in the
<br />office of the County Recorder of said Orange County; and it ~opearing that said deed
<br />was executed and delivered through a mutual mistake of the parties thereto, it being
<br />then the u~de~standing of said parties that said land was necessary fbr the widening
<br />of Baker Street to its present width, but that said land was never used or required
<br />for public street purposes; and it further appearing that neither the public interest
<br />or convenience require its use for such purposes, but that Baker Street as now lald
<br />out, and as shown on the map of said tract No. 92~, is of sufficient width for all
<br />present needs of the public for street purposes and any contemplated Use thereof by
<br />said City for such purposes;

<br /> NOW, THEREFORE, Be it Resolved, that said petition be, and the same is,
<br />hereby granted, and that the Mayor and the City Clerk be, and they are, hereby
<br />authorized and directed to execute and deliver in the name of and on behalf of the Cit
<br />of Santa Aha, a deed conveying to J.C.Metzgar and Belle H. Metzgar, husband and wife,
<br />as Joint tenants, all right, title and interest of said City of Santa Ana in and to th
<br />land hereinbefore described.

<br /> PASSED ANDADOPTED by the City Council of the City of Santa Ana at its
<br />regular meeting held on the 7th day of December, 1938.
