RESOLUTION NO. 2538 <br /> <br />RESOLVED BT THE CITY COUNCIL OF THE CITY 0F SANTA A~A: <br /> <br /> WHEREAS, the City of Orange has forwarded to this City a copy of <br /> Resolution No..678 of the City Council of that City offering to withdraw from <br /> the Joint 0utfall Sewer Agreement on certain ter~ therein set forth, and <br /> <br /> WHEREAS, this Council does not believe it advantageous to any of the <br /> parties to said Joint 0utfall Sewer Agreements to permit the withdrawal oD any <br /> parties thereto, for the reason that such withdrawal would au$omatically cast a <br /> greater burden for repairs, maintenance and upkeep upon the remaining member~ <br /> thereof, and <br /> <br /> WHEREAS, the parties to said agreements have invested the moneys of <br />the taxpayers of the several cities in such Joint Outfall Sewer under the agree- <br />ment and understanding of all parties to jointly bear the expense of upkeep and <br />repair thereof and s aid Joint 0utfall Sewer is new in need of repair, and this <br />Board is of the opinion ,that no party to said agreements should be peEnitted to <br />· escape its proper share of the burden thus cast on the several parties, after <br /> <br /> having enjoyed the benefits and advantages thereof during the already past years <br /> of such 0utfall Sewer, <br /> <br /> NOW, THEREFORE, this City of Santa Ana recommends to the City of Orange <br /> and to the other parties to said Joint 0utfall Sewer agreements, that all parties <br /> immediately endeavor to further cooperate on a procedure and plan which will have <br /> in purpose the continued maintenance, repair and upkeep of the Joint 0utfall <br /> Sewer for the mutual benefit of all parties to such agreements. <br /> <br /> The suggestion is made that a meeting of all parties to the Joint <br /> 0utfall Sewer agreements be held to discuss such proposition with the City of <br /> Orange, looking toward an abandonment of the offer to withdraw from such agreement <br /> <br /> ~That a copy of this Resolution be forwarded to each party to said <br /> Joint 0utfall Sewer Agreements. <br /> <br /> PASSED ~D ADOPTED by the City Council of the City of Santa Aua at its <br /> regular meeting held on the 1st day of November, 1937. <br /> <br />ATTEST: <br /> <br />E.
