RESOLUTION NO. 3126 <br />RESOLUTION ORDERING IMPROVEMENT <br /> <br /> WHEREAS, the City Council of the City of Santa Ana on the 18th day of <br />June, 1940, passed its Resolution of Intention No. 2?74 to order the hereinafter <br />described improvement to be made and public work to be done in the City of Santa <br />Ana, and <br /> <br /> WHEREAS, after the passage and adoption of Resolution of Intention No. <br />9774, J.L.McBride, the Street Superintendent of the City of Santa Ana conspicuously <br />posted along the line of the contemplated work and improvement at not more than <br />three hundred feet (300) in distance apart, and four (4) in all, notices of the <br />pass~ge of said Resolution of Intention headed "NOTICE OF PUBLIC WORK", in the <br />manner, form and substance as required by law; and said Street Superintendent also <br />caused a notice similar in substance to be published for a period of ten (10) <br />days in the Santa Ana Daily Evening Register, a daily newspaper published and <br />circulated in the CitY of Santa Ana, and named by said City Council in said <br />Resolution of Intention as the paper in which said notice should appear, all of <br />which appears from the affidavit of W.L.Millis, the bookkeeper and accountant for <br />said daily newspaper, and which affidavit was filed in the office of the Clerk of <br />the City of Santa Ana on the 30th day of March, 1940, and is now on file therein, <br />and <br /> <br /> WHEREAS, the Street ~uperintendent of the City of Santa Ana cow, menced <br />posting the notices hereinbefore referred to on the 20th day of March, 1940, aud <br />fully completed the postings thereof on the ~0th day of March, 1940, all of which <br />appears from the affidavit of J.L. McBride, Street Superintendent of the City of <br />Santa Ana, filed in the office of the Clerk of the City of Santa Ana on the 21st <br />day of March, 1940, and more than ten (10) days have expired after the expiration <br />of the time of the publication of said notice, within which protests or objections <br />to the proposed work or improvement might be made by any person interested, object- <br />ing to said work or improvement or to the extent of the district or lands to be <br />affected or benefitted by said work or improvement, and to be assessed to pay the <br />costs and expenses thereof, and <br /> <br /> WHEREAS, at the next meeting of the City Council after the expiration <br /> <br />of said ten (10) days following the expiration of the time of said publication of <br />said notice, the City Clerk presented to the City Council all objections to the <br />said proposed work which had been delivered to the Clerk of the City Council, who <br />endorsed thereon the date of reception by him, and the City Council having fixed <br />a time for hearing said objections, not less than one week after fixing such time, <br />and the City Clerk having thereupon notified all the persons making such objections <br />by depositing a notice of the time and place of hearing thereof in the post office <br />of the City of Santa Ana, California, postage prepaid addressed to such objector, <br />and the time fixed for hearing such objection having arrived, and said City Council <br />having heard the objections against said work or improvement which were made or <br />filed herein, and having considered the same, and overruled said objections to said <br />work or improvement, and the City Council of the City of Santa Ana having now <br />acquired Jurisdiction to order the proposed improvements; <br /> <br /> <br />
