Section 7. That the said grantee and his or its <br />successors or assigns shall during the life of said franchise <br /> <br />pay to the City of Santa Ana, in lawful money of the United <br />States, two (2) per cent of the gross annual receipts of <br /> <br />such 2rantee and his or its successors or assigns arfsiug <br /> <br />from the use, operation and possession of said fraRct~ise. <br /> <br />The first payment of such ilercentags shall be for the per- <br /> <br /> fed o~ one (1) year follow~nZ the passage of this "Ordinance <br />..a~'n~.~n.~'~ this franchise, and thereafter annually, dur~n~ <br /> <br />thc lige <br />porat'iou <br />City and <br /> <br />of this franchise, the grantee herein beingla ocr- <br /> <br />e~ercieinZ rights already on the streets of s~ id <br />this franchise being a renewal of a franchise <br /> <br />already ~ranted to the ?re~l~csssors of this gran~ee. <br /> <br /> The amount o~ the gross receipts of the person or cor- <br />poration to ~hom this franchise ~is granted or awarded, aris- <br /> <br />lng fret: it~ dss ,operation or possession ~all be deemed <br />and understood to be the total ~.ross earn~.n.s c'olle~ted <br />or received or in any manner gained or d~,r~d by th~ grantee <br />of this franchise, or its successors dl~esigns, fro~ gas <br />charges or rat~s charged for the sale and consumDtior~ of <br />gas or .~as product, used and consumed within the cor~o~ rate <br />limits of the City o~ ~anta Ana. <br /> <br /> It shall be the duty o~ the ~rantee, its aueces~rs <br />or a~eizns, when such psrc~-~,ntage becomes paymble ,. to ~file <br />with the City clerk of th~ ~,~ity of Sania ~Ana', at the <br />expiration of one year from the passage and p~b!Ication of <br />said Ordinances, granting said franchise, and at the ex <br />piratton of each an~] every year thereafter during th~ life <br />of said franchi:~ a s~atement verified by th~ oath o~ the <br />proper officials of said grantee its successors or assigns, <br />showin~ the gross receipts and ~ross earnings collected or <br />rec~ived, or in any mmnnsr gained or dertve~ by sa~d <br /> <br />grantee, its successors or assigns during the preceding <br /> <br />· twelve months, from gas charges and sales of gas sold and <br /> <br />~,onsun~ed by the customers of ,grantee and incomes or any <br /> <br />other business done by grantee or its successors or assigns <br /> <br />in connection with the business covered by this franchise in <br /> <br />the City of Santa Ana; and within fifteen (18) days after <br /> <br />the time for filing of the aforesaid statement~ it shall be <br /> <br />the duty of said ~rantee, its successors and assigns, to pay <br /> <br />to the treasurer of the City of Santa Aha, the aggregate sum <br /> <br />of such percentage upon the amount of the gross annual re- <br />ceipts arising from the use, operstion and ~ossession of said <br />~ranch~se, and which may at the t~me be owing~ .to the sa{d <br /> <br />rankle from any such sources, dsterr~ined or com~uted in tho <br /> <br />manner hereinbefore provided; and upon any neglect, orm]dssic~ <br /> <br />or refusal by said grantee, or its successors or assigns to <br /> ~ed statement, or to~ paM said per..enta~ of <br /> <br /> <br />
