166 <br /> <br />ORDINANCE NO. 619. <br /> <br /> An Ordinance establishing a municipal market, <br />defining its location, prescribing rules and regulations for its <br />conduct, fixing the fees to be charged vendors, providing Mm <br />permits for vendors and providing municipal market fund, creating <br />the office of market master and defining the duties and fixing <br />the compensation incident thereto, authorizing ths cultivation <br />of vacant lots and other property, the marketing of the products <br />therefrom, and the employment of laborers therefor, and fixing <br />their compensation, and providing a penalty for the violation <br />of the provisions of said Ordinance. <br /> <br /> The Board of Trustees of the City of Santa Ana, <br />do ordain as follows:- <br /> Section 1. That the public convenience and necessity <br /> requiring there is established in the City of Santa Ana, a munici- <br /> pal market for the sale of the commodities hereinafter mentioned <br /> and such other commodities as may hereafter be permitted to be sold <br /> at said market. <br /> <br /> Section 2. That said municipal market shall be <br />located along the North and East side of Birch Park on West Third <br />Street between Birch and Ross Streets in the City of Santa Ana, <br />California. <br /> <br /> Section 3. That said municipal market shall be <br />open for business from 7 o'clock a.m. to 12 o'clock m., on every <br />Tuesday, Thursday and Saturday; provided that said market shall <br />not be open on any legal holiday or any day that may hereinafter <br />be designated as a legal holiday by the governor of the State of <br />California, or the President of the United States. <br /> <br /> Section 4. That the market master shall divide <br />the territory covered by said market along the curb line into <br />spaces of 8 feet in width and shall mark and number said spaces <br />consecutively. <br /> <br /> Section 5. That the market master shall allot <br />spaces or portions of spaces to vendors holding permits' herein <br />provided for and no vendor shall occupy more than one space nor <br />more than one location at said municipal market, nor any space <br />or location not previously allotted to said vendor by the market <br />master; and if any space is not occupied by the vendor to whom <br />the same has been allotted by 8:30 o'clock a.m., On any market <br />day, said vendor shall forfeit the right to use said space for <br />said market day and the same may thereafter be re-allotted to <br />any other vendor for said market day, and the price paid therefor <br />for said day shall also be forfeited to the City. <br /> <br /> Section 6. That each vendor shall not have more <br />than one helper at said municipal market. <br /> <br /> Section ?. That vendors shall not sell or ~is- <br />tribute any commodity to any other vendor at said market. <br /> <br /> Section 8. That vendors shall not sell or offer <br />for sale at said market any commodity which is not wholesome, <br />clean and sanitary. <br /> <br /> Section 9. That vendors shall not use any scales, <br />weights or measures which do not conform to the standard of weights <br />and measures of the State of California. <br /> <br /> Section 10. That vendors shall keep all berries <br />under screens, all cooked foods, game, relishes and dairy products <br />in glass cases, all commodities not less than 18 inches above the <br />surface of the street and shall comply strictly with all the sani- <br />tary laws of the City of Samta Ana and State of California. <br /> <br /> Section ll. That no person, firm or corporation, <br />shall distribute hand bills, advertising matter or literature of <br />any kind at said market. <br /> <br /> Sectionl2. That no person, firm or corporation <br />shall fix or attempt to fix, regulate or attempt to regulate,or <br />combine with any other person, firm~ or corporation, or any other <br />persons,firms or corporations to fix or attempt to fix or regulate <br />or attempt to regulate the price or prices of commodities of <br />said market. <br /> <br /> Section 13. That vendors shall remove their horses <br />and mules from s~id municipal market before 8:30 o'clock a.m. <br />on each market day and said animals shall not be returned to said <br />market, before the closing mmX of the same, and that vendors shall <br />not keep horses or mules within the vicinity of said market,during <br />the business hours of said market. <br /> <br /> Section 14. That vendors shall not acquire or <br />replenish their stock of commodities at the municipal market <br />nor on any of the streets along which said market is or may be <br />located. <br /> <br /> <br />
