ORDINANCE NO. 625. <br /> <br />Am Ordinance of the City Of Santa Ana, to be known as the Build- <br />ing Ordinance, regulating the Construction, alteration, repair, <br />and ~emolition of buildings and structures and parts thereof and <br />providing for fire protection, regulating area ways and materials <br />and machinery, and use of streets in connection with building or <br />wrecking operations, providing for permits for same and repealing <br />all Ordinances in conflict therewith. <br /> <br /> The Board of Trustees of the City of Santa Ana, do ordain as <br />follows: <br /> <br /> Section 1. There shall be a building inspector and such <br />assistant inspectors as the Board of Trustees may deem necessary <br />appointed by and holding office at the pleasure of the Board. <br />No person shall be appointed either as inspector or assistant in- <br />spector who has not had at least ten years experience either as a <br />designer or constructor of buildings. <br /> It shall be the duty of the building inspector to make such <br />inspections as may be necessary to see that the provisions of this <br />Ordinance are complied with. The building inspector is hereby <br />given authority~to enter any building in the City of Santa Ana in <br />the performance of his duties and is further given authority to <br />order and compel the suspension of any or all work, or the occupancy <br />of any building on which any work is being done, or which is being <br />occupied in violation of the provisions of this Ordinance. <br /> Section 2. It shall be a violation of this Ordinance for <br />any person to continue the construction or use of any building or <br />part thereof if the building inspector has directed in writing <br />that such construction or use be suspended. The posting of a <br />written or printed notice on the building shall be considered a <br />sufficient notification as required in this Ordinance, and it shall <br />be a violation of this Ordinance to remove such a notice except by <br />permission of the building inspector. The building inspector is <br />hereby given aut'~:ority to delegate any or all of his powers to <br />his assistants at his pleasure. <br /> Section 3. Whenever the building inspector shall find that <br />any structure or part thereof is in a condition dangerous to <br />persons or property by reason of mny defective construction or <br />unsafe condition rendering the building unsafe for the purpose for <br />which it is used,; or does not comply with the regulations enacted <br />for the protection of life and property in case of fire, he shall <br />notify the owner or post a notice on the building calling atten- <br />tion to the defects in the building or part thereof, and within <br />forty-eight hours after such notice has been served or posted, work <br />must be begun on, and the building or part thereof, made to <br />comply with this Ordinance. <br /> Where the public safety requires immediate action the build- <br />ing inspector may and is hereby given authority to enter upon the <br />premises with such assistants as may be necessary and cause the <br />said structure to be made secure or taken down without delay at the <br />expense of the owner or party interested, and such expense shall <br />constitute a lien against the property. <br /> Section 4. The building inspector is hereby given author- <br />ity to rule as to the meaning of the various provisions of this <br />ordinance and to allow the substitution of equally strong or <br />serviceable construction in place of any specified by this Ordi- <br />nanoe~ but in case where any ruling is made by the building in- <br />spector regarding substitute construction or in deciding any <br />disputed question as to the meaning of any part of' this Ordinance, <br />a written copy of such decision shall be posted in a conspicuous <br />place easily accessible to the public in the office of the build- <br />ing inspector, and these decisions shall be kept permanently on <br />file in a place as noted above and in such a manner that they may <br />be easily consulted by any one wishing to examine them. <br /> Section 5. In ca~e of dissatisfaction with any ruling of <br />the Building Inspector, except in the case of unsafe buildings <br />requ~ing immediate attention, the question in dispute may be <br />referred to a board of appeal the decision of a majority of whom <br />shall be binding. Such a board shall be composed of three persons <br />qualified to decide the question at issue, one appointed by the <br />building inspector, one by the party making the appeal and the <br />third by the two members already chosen. Members of the board of <br />appeal shall each receive $5.00 for their services in the case of <br />each appeal for each day or part of a day that their services are <br />required. Appealw from the decision of the building inspector <br />shall be m~de by filing with the building inspector a specific <br />statement of the question that the appellant desires passed upon. <br />The appellant shall deposit with the building inspector the sum of <br />thirty dollars at the time the appeal is made. This appeal must <br />be made within five days after the building inspector has passed <br />upon the question in dispute. If the board of appeals shall <br />decide in favor of the appellant, deposit made shall be returned <br />and the expense paid by the city, but if the decision is against <br />the appellant, the deposit shall be used to defray the expense, <br />of the Board of Appeal. <br /> The power of the Board of Appeal shall be limited to <br />passing upon the true intent and meaning of the various prSvis- <br />ions of this Ordinance Or upon the substitution of equally good <br />or more desirable construction, but they shall not have power <br />to otherwise modify any of the provisions of this Ordinance. <br /> Section 6. It shall be unlawful for any firm, corpora- <br />tion, person, owner, arohltect,.lessee, builder, occupant or other <br />person to commence or proceed w~th the erection, cons~ruction, <br /> <br /> <br />
