216 <br /> <br />freight care shall be handled to or from the "Irvlne Extension" <br />through Santa Ana by way of the 4th Street Nain line of the <br />grantee; except to or from points on the Santa Aha 4th St. line <br />and then only between Santa Aha and Watts inclusive; provided <br />however, that the grantee herein shall be limited in its ehip- <br />merits of freight in ca~load lots to Watts and intermediate poi~te <br />on the 4th Street line to freight directly consigned to these <br />points and not to be thereafter diverted or re-consigned to points <br />beyond Watts, nor to receive freight in carload lots from points <br />beyond ~atts for the 4th Street line to be diverted to the Irvine <br />extension. <br /> <br /> It is further provided that the transportation of continental <br />freight over the Second Street and Maple Ave. track be confined <br />to the hours from 6 a.m. to <br /> <br />use <br /> <br />Section 3. Said grantee and its successors or assigns shall <br />in the construction of said road the best material, including <br /> <br />rail weighing not less than fifty (50) pounds per yard, such as <br /> <br />is used on first class railroads, which rail shall be satisfactory <br />to the Board of Trustees of the City of Santa Ana; and the said <br />rails shall be so laid as to be continuously welded, or otherwime <br />securely fastened together, and the said grantee and its successors <br />or assigns shall, at its or their expense and cost, pave or macadam- <br />ize, ~avel or otherwise improve the said streets between the ~aile, <br />and for two (2) feet on e~ch side thereof with the same material <br />used by the City of Santa Aha and under the same specifications <br />and in the same manner as upon said streets across which said <br />road runs respectively, and shall keep same constantly paved, <br />graveled or macadamized and in good repair and make the same con- <br />form at all times to the established grade of said streets res- <br />pectively, and the rails thereof shall conform to and be flush <br />with the surface o£ said streets respectively; and all such relaairs <br />and grading shall be done under the direction and to the satisfac- <br />tion of the Board of Trustees, or the superintendent of streetsof <br />said City of Santa Aha, at the expense of said grantee of this <br />franchise, its successors or assigns, provided however, that at <br />all times when the tracks of the grantee shall cross any street, <br />alley, avenue, court or place, which shall not have been paved <br />then the grantee at the time of construction of its track thereon <br />shall pave, and at all times thereafter during the life of its <br />franchise it shall maintain the said road between the rails thereof <br />and for two £eet each side thereof with crushed rock and oil maca- <br />dam, and when said street, alley, avenue, court or place shall <br />have been improved by public authority in the construction of <br />pavement thereon, the grantee shall repays the same between the <br />rails and two feet each side thereof with the s~me material and <br />under the same specifications as shall then be prescribed for the <br />other portion thereof by the grantor. In case said grantee, its <br />successors or assigns shall fail to comply with the instructions <br /> <br /> <br />
