365 <br /> <br /> Now therefore, at this a subsequent meeting of the <br />legislative bran(;h of said city, after the passage of <br />Resolution No. ?59, <br /> <br /> The Board of Trustees of the City of Santa Ana do ordain <br /> as follows: <br /> <br /> Section I. <br /> <br /> It having been determined and declared by Resolution No. <br />759 of the City of Santa Ana, passed by the vote of two-thirds ~nd <br />more of all the members of the Board of Trustees of said City, as <br />the legislative branch thereof, that the public interest and also <br />the public necessity demands the construction by the City of Santa <br />Ana, Jointly with the City of Anaheim, a municipal corporatbn, of <br />a municipal improvement, being a Joint outfall sewer, consisting of <br />the acquisition of sufficient la,nd at or in the immediate vicinity <br />of the East quarter cornsr of Section 32, Township 5 South, Range <br />l0 West, S.B.B.&I~., to be used as a sewer treatment site, upon <br />which to construct a sewer treatment plant, also the acquisition <br />of all necesssmy materials, apparatus, appliances, machinery and <br />equipment with which to construct and the construction on the <br />sewer treatment site of a sewer treatment plant, adequate for the <br />reception of audfor the proper, sufficient, and scientific treat- <br />me~t of-sewage, also the acquisition of the necessary right of way <br />extending from the sewer treatment site in a southerly direction <br />approximately 23,750 feet to the Pacific Ocs-an, upon which to con- <br />struct a sewer pipeline, arid also the acquisition of approximately <br />23,750 feet of 36-inch internal diameter sewer pipe, and tls <br />necessary materials and equipment with which to construct and the <br />construction on the right of way arid connected w~th the sewer <br />treatment plant of a sufficient and adequate sewer pipeline, with <br />proper manholes, outlets, and ~pplianoes for the transmission of <br />sewage from the sewer treatment plant to, ~ud the discharge there- <br />of in the waters of the Pacific Ocean, in order to carry out the <br />objects, purposes a~ud powers of the City of Santa Aha, and the <br />cost thereof, ~ud the proportion of thc cost Zhercof to be paid <br />by the City of Santa Ana will be too great to be paid out of the <br />ordinary annual income and revenue of t e City of Sants~ Aha. <br /> <br /> It is hereby further determ2ned ~nd declared that the <br />Board of Trustees of the City of Santa Aha propose to incur a <br />bonded debt 'and to issue ~ud sell the bonds of the City of Santa <br />An~ to pay the proportionate part of the cost of said municipal <br />improw~ment, to wit: said joint outfall sewer, required to be paid <br /> <br />by the City of Santa ;~ua. <br /> <br />(The use hereinafter in this <br />"Joint outfall sewer" means s~ _.~ <br /> <br />Or~dinance of the phrase <br />at all times be construed <br /> <br />to mean the municipal improvement set forth in Resolution No, <br />759, and in this Section described.) <br /> <br /> The objects and purposes for which the indebtedness is <br /> <br /> <br />
