369 as the legislative branch thereof, that the public interest and also the public necessity demands the construction by the Oity of Santa Aha of a municipal improvement, being street work, con- sisting of the p~ving of or portion of West Fifth Street, an open public street in the City of Santa Ana, from the place of its intersection by Baker Street west to the westerly boundary of the city of Santa Ana, with an adequate concrete base overlaid and finished with an asphaltic concrete top or ~-~earing surface, and the construction in and across West Fifth Street at a point there- on approximately 42.5 feet west of the center Line of English Street of one concrete twin culvert, in order to carry out the objects, purposes and powers of the city of Santa Aha, and the cost thereof will be too great to be ?.ai~% out of the ordinary annual income and revenue of the city of Santa Ana~ (The uss hereinafter in this Ordinance of the words or phrase "West Fifth Street paving and culvert" is intended to mean and sl%all at all times be construed to mean the municipal improve- ment described in this Section and set forth in Resolution It is hereby f'u~rther determined and declared that the Board of Trustees of the city of Santa Aha propose to incur a bond- ed debt and to issue a~ud sell the bonds of the city of Santa Aha to~ pmy the~cost of said municipal improv.~ment, to-wit: said West Fifth Street paving and culvert. The objects ~nd purposes for which the indebtedness is proposed to be incurred is to pay the cost of the construction of the West Fifth Street paving and culvert in order to make West Fifth Street, a public street in the city of Santa Aha, safe, adequate and convenient for public travel. The cost of the West Fifth Street paving a~..d culvert is estim~ted to be $22,000.00, a~d the a~ount of the principal of the indebtedness to be incurred therefor is the sum cf $22,000.00, which su~ is and will be too great to be paid out of the ordinary annual inoo~ue arid revenue of the city cf Santa Aha. The maximum rate of interest to be paid on such indebt- edness is hereby fixed at five per cent. per annum, payable semi- annually, which rate of interest shall not be exceeded in the is- suance of bonds for such indebte&~ess. S. ection. 5.
