ORDINANCE NO. 801 AN ORDINANCE granting to Pacific Electric Railway Company, a corporation, its successors ~nd assigns, the right to construct and maintain one track across and upon Fourth Street, and two tracks across Third Street, in the City of Santa Rna, California. The Board of Trustees of the City of Santa ~hua, do ordain as follows:- SECTION 1. That the right be and the same is hereby granted to Pacific Electric Railway Company, a corpo~'ation, its successors and assigns, to construct and for a period, of fifty years to maintain and operate, a single track electric railroad across and upon Fourth Street, and two single electric railroad tracks across Third Street, over the routes described as follows:- Co~encing at a point in the present constructed south track of the Pacific Electric Railway on Fourth Street, distant easterly thereon 224.0~ feet from the center line of French Street; thence easterly along a curve concave to the south and having a radius of 150 feet, a distance of 37.39 feet; thence southeasterly, tangent to said curve, S feet; thence southeasterly along a tangent curve concave to the southwest and having a radius of 175 feet, a distance of 66.95 feet; to a point in the south line of Fourth Street distant easterly thereon $28.29 feet from the center line of French Street. Also, commencing at a point in the north line of Third Street, distant easterly thereon S50.50 feet from the center llne of French Street; thence southeasterly 88.8 V feet to the beginning of a tangent curve concave to the west and having a radius of 470 feet; thence southerly along said curve, ~.99 feet to a point in the south line of Third Street distant easterly thereon 559.78 feet from the center line of French Str~et. Also, commencing at a point in the north line of Third Street, distant easterly thereon ~89.74 feet from the center line of French Street; thence southerly in a direct line to a point tn the south llne of Third Street distant easterly t]uereon ~8~.~0 fegt from the center line of French Street. SECTION ll. Said grantee, its successors and assigns, shall use in the construction of said work the best materlal~ including r~ Is weighing not less than sixty pounds per yard, and the grantee hereof shall pave or macadamize said road between the rails and for two feet on each side thereof with the same material used by the city upon the streets over which said tracks run, and keep the same in repair flush with the street, and shall make the roadbed conform at all times to the established grade of said streets, and all repairs and grades to be made un~er the instruction and to the satisfaction of the Street Superintendent of the Board of Trustees of said City; in case the said grantee fails to comply with the instructions given for said repairs for ten days after ser~dce of notice thereof, the City of Santa Ana may enter upon the road of said grantee and do the work and keep an itemized account thereof, which said grantee, by acceptance of this franchise, agrees to pay i~nediately on the presentation to said grantee of said account.
