RESOLUTION NO. 65-151 <br /> <br />RESOLUTION DETER~iINING THAT THE PUBLIC CONVENIENCE <br />AND NECESSITY REQUIRE IMPROVEMENT WORK, AND ORDERING <br />WORK, ASSESSMENT DISTRICT NO. 229, SANTA ANA,CALIFORNIA <br /> <br /> WHEREAS, the City Council of the City of Santa Ana, Calif- <br />ornia did, on August 2, 1965, in adopting its Resolutions No. 65-118 <br />and 65-119 in this improvement district, order that a public hearin~ <br />be held on Tuesday, September __7__, 1965 at 7:30 o'Clock P.M. ~ <br />in the Council Chambers in the ~i~ Hall in said City of Santa Aha, <br />concurrently with the protest hearing under its said Resolution of <br />Intention No. 65-119, for the purpose of finding and determining <br />whether the public convenience and necessity require the improve- <br />ments proposed to be constructed as described in said Resolution <br />of Intention No. 65-119; and <br /> <br /> lrHEREAS, notice of the adoption of said Resolution No. <br />65-118 and of said Resolution of Intention No. 65-119 by mailing, <br />posting and publication was given in the t~m~, form and manner as <br />required by law, as shown by the affidavits of mailing, posting and <br />publication on file in the office of the Clerk of the Council of <br />said City of Santa Ana; and <br /> <br /> WHEREAS, protests or objections, in writing or otherwise, <br />made by the owners of more than half of the area of the property to <br />be assessed for said improvements against the proposed work and <br />improvement, the extent of the district to be assessed, or the grades <br />to which said work is proposed to be done, have not been made or <br />presented up to the hour set for hearing in and by said Resolution <br />of Intention No. 65-119, and no other person appeared at said public <br />hearings and made objection that the public convenience and <br />necessity did not require such improvement; and <br /> <br /> WHERF2kS, said City Council received testimony from the <br />Director of Public Works of said City of Santa Aha that said pro- <br />posed work and improvement in the assessment district proposed to <br />be assessed for such work and improvement was necessary as a health <br />measure, would furnish sanitary sewage disposal services to all of <br />the property within said proposed improvement district, would be of <br />a benefit to all of said property within said proposed improvement <br />district as a health measure, and that the public convenience and <br />necessity require such improvement. <br /> <br /> N~4, THEREFORE, BE IT RESOLVED by the City Council of the <br />City of Santa Ana, California, in regular session assembled this <br />~ay of September, 1965, that said City Council hereby finds <br /> rmines that said proposed work and improvement is feasible, <br />and that the public interest, convenience and necessity require such <br />improvement, and that all protests, both oral and in writing, to the <br />doing of said work be and the same hereby are overruled and denied. <br /> <br /> BE IT FURTHER RESOLVED that said City Council hereby orders <br />that the work and improvement as set forth and described in said <br />Resolution of Intention No. 65-119 passed and adopted by said City <br />Council on the 2nd day of August, 1965, and in the plans and speci- <br />fications therein referred to and adopted, be done in the manner <br />described in and provided by said resolution of intention and said <br />plans and specifications. <br /> <br /> BE IT FURTHER RESOLVED that the boundaries of the assess- <br />ment district, and the grades to which said work and improvement <br /> <br />-1- <br /> <br /> <br />
