146 <br /> <br /> ORDINANCE NO. 879 <br /> <br /> AN ORDINANCE OF THE CI%~ OF SANTA ANA, ESTABLISHING <br /> SET-BACK LIi~S UP011 N6RTI[ ROSS STREET, ON BO~t SIDES <br /> OF SAID STR~ET, FR0~ NINETEENTH STREET TO SANTA <br /> CLARA AVENUE, EXCEPTING THE C OR~R L~'S F~\CING <br /> NINETEENTH STREET AND SANTA CLARA AVENUE RESPECTIVELY. <br /> <br />The City Council of the City of Santa f~na do ordain as follows: <br />Section 1. That the public interest and convenience requires, and <br />there is hereby established set-back lines upon the following street in the City <br />of~Santa Ana~ California, between which and the respective street lines of said <br />street it shall be unlawful for any person, firm or corporation to erect any <br />building., wall, fence or.other structure, or place any structure thereon, to-wit <br /> <br /> North i{oss Street on both sides of said street, from Nineteenth <br />Street to Santa Clara Avenue, forty (40) feet outside of the present East and <br />~est lines respectively of said street, excepting from the provisions hereof the <br />corner lots on said portion of North Ross Street fronting on Nineteenth Street <br />and Santa Clara Avenue respectively. <br /> <br /> Section 2. That the foregoing set-back lines are established after a <br />Resolution of Intention was duly passed and adopted and a hearing held thereon, <br />after notice by publication and posting in the manner prescribed by Ordinance <br />No. 813 of the City of Santa Ana, entitled, "~ Ordinance Prescribing the l[ethod <br />of Procedure for Establishing Set-back Lines in the City of Santa Ana" and the <br />City Cothnsil having heard and passed upon all protests or objections filed or <br />made to the establishment of said set-back lines. <br /> <br /> Section 3. That the Building Inspector of the City of Santa Aha shall <br />refuse to issue any permit for any building, wall, fence or other structure <br />proposed to be erected within the space between the present street lines of <br />the &bove mentioned street and the set-back lines established by this <br />Ordinance. <br /> <br /> Section 4. That any person, firm or corporation violating any of <br />the provisions of this ordinance shall be deemed guilty of a misdemeanor <br />and upon conviction thereof shall be punished by a fine of not more than Five <br />Hundred Dollars ($500.00) or by imprisonment in the County Jail of the County <br />of Orange, for a period of not more than six months, or by both such fine and <br />imprisonment. Each such person, firm or corporation shall be deemed guilty <br />of a spearate offense for each day during any portion of which any vuilation <br />of this ordinance shall be permitted, continued or committed by such person, <br />firm or corporation, and shall be punishable therefor as provided by this <br />Ordinance. <br /> <br /> Section 5. That the City Clerk shall certify to the passage of this <br /> ordinance and cause the same to be published three times in the Santa Ana <br /> <br />Daily Evening Register, a daily newspaper printed, <br />circulated in the City of Santa Aha, and the same <br />force thirty (30) days from the date of its final <br /> <br />published and generally <br />shall take effect and be in <br />passage. <br /> <br /> The foregoing ordinance is signed and approved by me this 8th day of <br />July, 1929. <br /> <br /> F.
