ORDINANCE ~0. 939. AN ORDINANCE OF THE CITY O~ SANTA ANA~ ACCEPTING THE REAL PROPERTY AND TRI~ST ESTATE O~FERED TO THE CITY OF ~AN~A AMA, UNRER THE TE~MS AND CONDITIONS PROVIDED FOR IN THAT CERTAIN TRUST AGB~i~:~ENT DATED THE 28th DAY OF MAY~ 1924, EXECUTED BY C. W. BOWERS AND ADA A. BOW~RS~ HIS WIFE~ AS TRUSTORS, AND THE FIRST NATIONAL BANK OF SANTA ANA, AS TRUSTEE; CREATING A BOARD OF MUSEUM TRUSTEES, AND PRESCRIBING THEIR DUTIES AND POWERS; AND AUTHORIZING THE EMPLOYMENT OF AN AR(X~ITECT TO PHEPAP~E PLANS AND SPECI~ICATIQNS FOR THE BUILDING TO STRUCTED UNDER THE TERMS OF SAID TRUST AGRE~ENTe ~The .City coUnci~ of th~ City of Santa Ana do ordain as follows: SECTION l: That the City of Santa Aha, a munlciDal corporation, hereby accepts the real property and trust estate, hereinafter particularly described, under the terms and conditions set forth in that certain trust agreement dated May 28th, 1924, executed by C. W. Bowers and Ada A. Bowers, his wife, as Trustors and The First ~ational Bank of Santa Aha, a corporation, as Trustee, wherein the following described real property is offered as a gift to the City of Santa Ana, together with all the remainder of the trust estate, created by said agreement, now remaining in th~ hands of said Trustee, on condition that said real property shall be used exclusively as a building site for a Charles W. Bowers Memorial Museum; that the City of Santa Aha shall begin and thereafter continue construct- ion of a suitable Museum Building on said real property within one year from the date of death of the last surviving Trustor named in said agreement, using the funds derived from the residue of the trust estate towards the erection and ishing of said building and beautifying the grounds; that said Museum Building is to be known as the "CHARLES W. BOWERS MEMORIAL MUSEUM", to be of fire-proof con- struction, and should the trust estate not be sufficient to build a suitable Museum, suitable for a City of the size of'Santa ~tua, that the City of Santa Aha is to raise sufficient funds to be added to the ar~ount received from the trust estate, to construct said building and furnish the s.~ne and beautify the grounds in a suitable manner acceptable to the Trustee named in said trust agreement; and that said City of Santa Ana will accept and agree to maintain the same for all time as a Charlos ~. Bowers Memorial Museum; that the Historical Society of Santa Ana is to be allowed the free use of the building for their meetings, and that said Historical Society, for that privilege, be permitted to assist in the furn- ishings of displays, furniture and fixtures for said buildings. SECTION 2. That the real property hereinbefore ~eferred to.and upon which said Museum Building shall be built is located at 2010 North Main Street, the City of Santa Ana, County of Orange, State of California, and is particul~rly described as follpws: All of Lots One (1) and Two (2) in Block "B", except the West twenty (20) feet of said Lots; ' all of Lot Three (8) in Block "B"; and all of Lot Eight (8)~ in Block "B", except the West 280 feet of said Lot Eight (8); all in the Resubdivision o£ Blocks "A" and "B" of the Orange Grove Tract of Santa Ana~ as shown on a Map recorded in Book l, page l~, of Miscellaneous Maps, Records of Orange County, California. That the City of Santa Ana in accepting said property and the residue of the trust estate under said trust agreement is required to submit to the Trustee plans acceptable to the Trustee, of the Muse~nn Building and furnishing of the same, together with outline of beautifying the grounds, before construction shall begin.
