293 <br /> <br /> SECTION 6: Upon receipt of any such application referred to in Section <br />hereof,,the Board shall make investigation, and may thereafter grant the same if it <br />shall find: <br /> <br /> 1. That the bond or policy of insurance hereinafter required has been <br />furnished, and that the same is in the form required, and that the surety thereon is <br />approved by the Board; and <br /> <br /> 2. That each vehicle described therein is adequate and safe for the purpose <br />for which it is to be used, and is equipped as herein required; and <br /> <br /> 3. That the applicant has complied with all the terms and conditions e~ <br />this ordinance; and <br /> <br /> 4. That the public convenience or necessity require the operation of such taxica' <br />or motor bus upon the public streets. <br /> <br /> 5. In case of an application for taxicab permit, that the color scheme, name, <br />monogram or insignia to be used upon such car is not in conflict with and does not <br />imitate any color scheme, name, monogram or insignia used by another person, firm or <br />corporation in' such manner as to be misleading er tend to deceive or defraud the public, <br />or that a color scheme, name, monogram, or insignia has theretofore been designated for <br />said applicant; and <br /> <br /> 6. In case of an application for a taxicab permit, that the location of the <br />stand as therein stated is such that it will not congest or interfere with travel on <br />any public street nor the use of an~ p~blic street by the public, and is not prohibited <br />by any ordinance of the City of Santa Ana; provided, however, that no permit shall be <br />granted for a proposed taxicab stand on a public highway in the City of Santa Aha until <br />notice has been given by the Board to the person or persons whose names are required to <br />be set out in the list as provided for in Section 4, Subdivision 6 thereof, and ten (10) <br />days shall have elapsed from the time of the giving of such notice. Such notice <br />shall be in writing and state that an application has been made for a taxicab stand, <br />where the same is proposed to be located, and shall require any protests against the <br />granting of the same to be made in writing to the Board within ten (10) days from the <br />date thereof. The notice as herein provided for shall be deemed to have been given <br />upon the depositing of the same in the United States Postoffice in the City of Santa <br />Ana, in a properly stamped and addressed envelope; provided that where the name or <br />address of the person or persons entitled to notice are unknown, such notice shall be <br />given by posting the s~me for a period of ten (10) days Zn a conspicuous place upon <br />the property affected. Upon receipt of any such protest, the Board shall set a time <br />and place for hearing of the same, which time shall not exceed ten (10) days from the <br />last day for filing protests, and shall notify all protestants thereof by mail. Or <br /> <br /> 7. In case of an application for a motor bus permit, that the proposed route <br />or. routes therein described would not congest or interfere with travel on any public <br />street or the use of any public street by the public, and that any of said proposed <br />routes are not already adequately supplied with transportation facilities. <br /> <br /> ~ the case cf an application for a motor bus permit, the Board may grant <br />such permit for a different route or routes in whole or in part from that described in <br />the application, which different route or routes shall be described in the order grant- <br />ing such permit. <br /> <br /> The Board, subject to review by the Council as 'hereinafter provided, shall <br />have power to determine all issues relative to granting or denying taxicab permits, <br />taxicab stand permits, or motor bus permits. <br /> <br /> SECTION 7: The Board shall designate in any permit granted by it the exact <br />lo~ation of the taxicab stand. No such stand shall be wider than fourteen (14) feet <br />on streets where parking at an angle is permitted, or twenty (20) feet on streets where <br />parallel parking is required. Upon the granting of a permit under this ordinance, <br />every taxicab stand as d~signated by the Board shall be designated by red paint or <br />other red material upon the entire curb surface therein, with the words "TAXICABS ONLY" <br />in white letters thereon. <br /> <br /> SECTION 8: It shall be unlawful for the owner or driver of any taxicab ~o <br />park or stand the same upon any public highway in the City of Santa Ana, other than a <br />commercial or industrial zone or permitted taxicab stand, for any period of time longer <br />than it is ~ecessary to discharge or receive passengers then occupying or then waiting <br />for such taxicab; provided, that a taxicab shall not be parked for a longer period of <br />time than five (8) minutes in a conznercial or industrial zone, except in a permitted <br />taxicab stand. <br /> <br /> SECTION 9: Any one taxicab stand as herein defined that is granted to any <br />person, firm or corporation, may be used Joint ly by any two or more persons, firms or <br />corporations holding permits under this ordinance by the mutual consent of said persons, <br />firms or corporations, which said consent must be first reduced, to writing, properly <br />signed, and filed with the City Clerk of the City of Santa Ana, or by order of the Boar <br /> <br /> SECTION 10: No taxicab stand shall be changed except upon written application <br />to the Board, setting forth the proposed new. location. Such application shall be <br />a~com~anied by a list as provided for in Section 4, subsection 6 thereof, together with <br />such fee as the Board shall find necessary to compensate it for. clerical work and <br />expense of giving notice as is herein required. <br /> <br />Board. <br />in the <br /> <br /> SECTION ll: The route of any motor bus may be changed with the consent of the <br /> A written application for such consent shall be filed, and heard and determined <br />same manner as. an original application made under Section 5 hereof. <br /> <br /> SECTION 12: Every person, firm or corporation carrying passengers for hire in <br />any motor vehicle in the City of Santa Ana, shall obtain a license therefor and pay to <br /> <br /> <br />
