<br />AN ORDINANCE GRANTING TO SOUTH~iRN CALIFORNIA TkLkPHONE
<br />COMPANY, ITS SUCCESSORS AND ASSIGNS, THE RIGHT, PRIVILEGE
<br />AND FRANCHISE, FOR THE PERIOD OF FIFTY (50) YEARS, TO
<br />MAINTAIN, CONDUCT AND CARRY ON A GEN~AL TELEPHONE AND
<br />TELEGRAPH BUSINESS, AND IN CONNECTION THERAWVITH, AND
<br />FOR THE PURPOSES THEREOF~ TO CONSTRUCT, ERECT~ INST.~LL~
<br />MAINTAIN AND.OPERATE A SYSTEN AND PLANT FOR THE TRANS~
<br />MISSION OF SOUND, SIGNALS~ CONVERSATIONS AND INTELLIGENCE
<br />BY ~ANS OF ELECTRICITY. INCLUDING POLES AND/OR CONDUITS
<br />AND WIRES~ IN, ALONG, 09ER AND UNDER THE STREETS, ALLEYS
<br />AND PUBLIC PLACES AS NOW EXISTING AND AS HEREAFTER
<br />ESTABLISHED OF SAID CITY OF SANTA ANA, CALIFORNIA.
<br />
<br />The City Council of the City of Santa Ana, California, do ordain as
<br />
<br /> SECTION 1. That the privilege, right and franchise is hereby granted to
<br />Southern California Telephone Company, its successors and assigns for the term of
<br />fifty (50) years, and during the whole thereof:
<br />
<br /> To maintain, ~onduct and carry on a general telephone and telegraph
<br />business, and, in connection therewith and for the purposes thereof:
<br />
<br /> To construct, erect, install, maintain and operate a system and plant
<br />for the transmission of sound, signals, conversations and intelligence by means of
<br />electricity, in, over, along and under the streets, alleys and public places aa
<br />now existing and as hereafter established, of said City of Santa Aha; and,
<br />
<br /> To install, erect, and maintain poles and pole lines (with or without
<br />cross-arms or brackets)~ and appliances in, over and along, and to build conduits~
<br />(with man holes) and make the excavations necessary and proper therefor, in and
<br />under, said streets, alleys and public places, and to string, install, maintain
<br />and operate wires, cables and other appliances and conductors on such poles and in
<br />such c~nduits and man holes. Such wires and other appliances and conductors
<br />shall be either strung on poles and other fixtures above ground, or, at the option
<br />of the grantee, its successors and assigns, laid underground in pipes or conduits~
<br />or otherwise protected.
<br />
<br /> Nothing in said franchise contained shall prevent, interrupt, or inter-
<br />fere with interstate communications or interstate corm~erce.
<br />
<br /> SECTION S. That Southern California Telephone Company and its assigns
<br />shall pay annually to the said City of Santa Ana, during the life of this franchis
<br />two (~) per cent of the gross annual receipts arising from its use, operation or
<br />possession, and if said payment is not made, this franchise shall be forfeited.
<br />
<br /> SECTION $. That in consideration of the rights and privileges hereby
<br />granted, the City of Santa Aha shall have, and it hereby reserves, and the
<br />Southern California Telephone Company, its successors and assigns, hereby grants
<br />to the City during the life of this franchise, the right and privilege to place an.
<br />maintain, where aerial construction exists, a fixtures on the top of poles erected
<br />and maintained by the Company under this franchise, to which may be attached wires
<br />not exceeding four (4), or in lieu thereof, at the option of the company, to place
<br />and maintain wires, not exceeding four (4), on pins on the top crossarms of such
<br />poles where said facilities are available; and where underground conduit exists,
<br />the said company, its successors and assi~s, shall furnish said City of Santa Ana
<br />with one duct in its underground system excluding pipe or other conduit dips
<br />connecting one pole with another, or two pairs of wires in underground cable, free
