~of charge to said City, to be used for low tension police and fire alarm purposes, it
<br />being understood that it shall be optional with the grantee Company as to where two
<br />pairs of wires shall be given or a duct in the underground system.
<br />
<br /> PROVIDED, however, that said City of Santa Aha shall, in its use and maintenan
<br />of such fixtures, wires or ducts, comply with the reasonable plans and rules of the
<br />grantee, its successors and assigns, so that there may be a minimum danger of contact
<br />between its fixtures, wires and ducts, and the fixtures, wires, cables or ducts of the
<br />Company, its successors and assigns; nor shall the wires of the City of Santa Ana be
<br />unduly exposed to foreign electrical current in excess of five thousand (5,000) volts;
<br />AND PROVIDED, further, that in case of rearrangement of said plant, the City of Santa
<br />Ana will at its own expense, care for its own fixtures, wires and construction, and sai~
<br />Company, its successors and assigns, assumes no liability whatsoever, either to said
<br />City or to any person, firm or corporation whatsoever, for any damage or claim of any
<br />kind arisimg out of the construction, maintenanc$, operation, removal or presence of the
<br />equipment herein described and to be used by the City solely in maintaining the efficien~
<br />of its Tire alarm system and police force.
<br />
<br /> SECTION 4. That Southern California Telephone Company, and its successors
<br />and assigns, shall, for the term of this franchise, and without charge therefor, furnish
<br />to the City of Santa Ana, twelve (l~) individual line desk set telephone, or the
<br />
<br />equivalent thereof, in exchange~ service at the filed and authorized rates.
<br /> SECTION 5. This franchise is not exclusive.
<br />
<br /> SECTION 6, All the terms and ~nditions of this franchise shall bind and be
<br />binding on each and every assignee, holder and owner of the same, and on each and every
<br />person, firm a nd/or c~rporation lessee of any of its privileges.
<br />
<br /> SECTION 7. All construction work shall be of that standard required by the
<br />State Law and the orders of the Railroad Commission of the State of California, or any
<br />other body or governmental authority having Jurisdiction in the premises.
<br />
<br /> ~HERE not in conflict with the state law or the orders of the Railroad
<br />Commission or other body having jurisdiction in the premises, said poles and pole lines
<br />shall be placed and said conduits dug and constructed in accordance with the reasonable
<br />regulations of the City of Santa ima acting under its police powers.
<br />
<br /> SECTION 8. That whenever it becomes necessary to temporarily rearrange,
<br />remove, lower or raise the wires, cables, conduits or other apparatus of said grantee
<br />for the crossing thereof or of the line thereof by any building, machinery or other
<br />object or work, said g~antee shall temporarily rearrange, remove, lower or raise its
<br />wires, cables, conduits or other apparatus as the necessities of the base require, ~
<br />PROVIDED, HOWEVER, that the person or persons desiring to move any such building,
<br />machinery or other objectiou or to do any such work shall assume and pay to the grantee
<br />herein the cost of such rearranging~ removing, lowering or raising, and shall, in advanc~
<br />of such moving or work, deposit with said grantee cash or a good and sufficient bond to
<br />pay such cost, as estimated by said grantee, and said person or persons shall indemnify
<br />and agree to save grantee free and harmless of and from any and all damages or claims
<br />of whatever kind or nature, direct or consequential, caused directly or indirectly by:
<br />such crossing, passage or work and/or by the temporary changing, altering or removing
<br />of said wires, cables, conduits or other apparatus so as to permit of such crossing~
<br />passage or work.
