350 <br /> <br />ORDINANCE 998 <br /> <br /> AN ORDINANCE OF THE CITY OF SANTA ANA REGULATING <br /> AND PROHIBITING THE SOLICITATION FOR DONATIONS <br /> FOR CHARITY, THE PROMOTION AND CONDUCTING OF <br /> BAZAARS, SALES OR E~IBITIONS FOR CHARITY, AND <br /> pREBCRIBING PENALTIES FOR THE VIOLATION ~5/EHEOF. <br /> <br />The Board of Trustees of the City of Santa And ordains as follows: <br />S~CTION 1. It shall be unlawful for any person, firm, association or <br />corporation to make any appeal to the public for a charity, either by soliciting <br />or collecting gifts, contributions, domations or subscr%ptions, or by promoting <br />or conducting any bazaar, sale or exhibition, or by any other means whatsoeverw <br />at any place or to any person in the City of Santa And, unless an application <br />therefor has been filed with and a permit issued by the Board of Trusteee of the <br />City of Santa And, in the manner herein provided. <br /> SECTIO~ ~. Any person, firm, association or corporation desiring to <br />make an appeal to the publiS for a charity, either by soliciting donations or <br />subscriptions or by promoting or conducting any bazaar, sale, exhibition, or by <br />any other means whatsoever, at any place, or to any person in the City of Santa <br />Aha, may file an application with the Board of Trustees of the City of Santa And, <br />upon forms to be supplied by the City of Santa Aha, without charge t o the <br />applicant, setting forth the following information: <br /> <br /> (1) The name and address of the applicant. <br /> <br />The exact purpose for which the proceeds of the <br />solicitation, sale, bazaar, exhibition, or other <br />promotion are to be used. <br /> <br />(s) <br /> <br />The total sum which is sought to be raised and <br />estimated total amount to be expended as compensation <br />or reward for such solicitation, which statement shall <br />be verified by the oath of the person or Chief Officer <br />for whom solicitation is to be made. <br /> <br />(4) <br /> <br />The names and addresses of all persons who will be in <br />any manner engaged in the work. <br /> <br />The bank or place where all or any part of the funds <br />raised by such activity will be placed on depoeit or <br />~nvested. <br /> <br />(6) <br /> <br />Such other information in respect to the character, <br />and past and proposed activity of the applicant, as may <br />be necessary or desirable to enable the Chief of Police <br />to make a full and complete investigation. <br /> <br /> SECTION 5. That no application shall be granted hereunder, where the <br />solicitation expenses or overhead shall exceed ten per cen~ (10%) of the amount <br /> <br />sought tS be raised. <br /> <br />SECTION 4. The City Council of the City of Santa Ana must act upon all <br /> <br />applications filed with it pursuant to the px~vialon~ of this ordinance, not <br /> <br />later than ten (10) days after the date on which any such application is filed. <br /> <br />Should the said City Council, after a canplete investigation of the <br /> <br />applicant and of the representations contained in the application, be of the <br /> <br />opinion that the applicant has not stated true facts in his application, or that <br /> <br />if a permit should be grante~ to the applicant a fraud would in all probability be <br /> <br />perpetrated upon the public, it may refuse to issue a permit to such applicant. <br /> <br />Should the City Council be sotisfied that the application is truthful~ <br /> <br />that the applicant is scting in good faith, and that the public interest and <br /> <br />general welfare will not be injured by the applicant's proposed activity, it shall <br /> <br /> <br />
