ORDINANCE NO. 1021 <br /> <br /> A.N 0BDINANCE RE~U~TING DANCE HALLS, DAi~CING <br /> PAVILIONS AND PLACES WHEBE DANCES ARE I~EGULARLY <br /> C0~fDUCTED AND CARRIED ON IN THE CITY OF SANTA <br /> ANA, CALIFORNIA. <br /> <br /> THE COUNCIL OF THE CITY OF SAS~TA ANA DO ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1. That no license to conduct, maintain or carry on any oublic <br />dance hall or dancing pavi!~.on in the City of Santa Ana shall be issued to any <br />person, firm or corporation except upon a permit in writing previously granted <br />by the City Council of said City and filed with the City Clerk authorizing the <br />issue of such licenses to such person, firm or corooration and specifying the <br />location of the dance hall; that the City Council shall have power to refuse to <br />issue any such permit or to revoke any such permit when it shall appear to or be <br />determined by said Council that the public dance or hall or pavilion of the <br />person, firm or corporation by whom such application is made or to whom such <br />permit has been given is or will be conducted in an illegal, disorderly or <br />improper manner, provided that in c~se a permit granted to any person, firm or <br />corporation for a ~ublic ~ance hall shall be revoked by said Council, a new <br />license shall not be issued to such person, firm or corporation until a new <br />permit therefor shall have been granted by said. Council. <br /> <br /> That for the purpose of this ordinance, a public dance hall is hereby <br />defined to be a place maintained for the purpose of dsnclng therein and open to <br />the public for such purpose to which persons are admitted, or in which persons <br />are allowed to dance, upon the payment of a fee or charge. <br /> <br /> SECTION 2. In the event that any person, firm or corporation holding <br />a permit to conduct a public dance hall shall violate or cause or permit to be <br />violated any condition of such permit, or any provision of this ordinance or of <br />any other ordinance relating to or regulating the maintenance, conducting or <br />carrying on of cub!lc dance hall, or otherwise cause or permit the same to be <br />conducted in an illegal, disorderly or improper manner, or shall cause or permit <br />persons attending said dance to conduct themselves in a disorderly, drunken or <br />improper manner in or near said dance hall or the neighborhood thereof, it sh~ll <br />be the duty of the City Council to revoke such permit in any manner hereinafter <br />provided, and such revocation shall be in addition to the other penalties pro- <br />vided for a violation of any of the provisions of this ordinance. No such <br />permit shall be revoked until a hearing shall have been had by the City Council <br />in the matter of the revoc~tion of such permit, notice of which hearing shall be <br />given in writing and served at least three days prior to the date of such he~ring, <br />upon the holder of such permit, or his or its manager or agent, or person in <br />charge of such public dance ha!]. Said notice shall sta~e the ground of <br />complaint against the holder of such permit, and shall also state the time when <br />and place where such hearing will be had. Said notice shall be served by <br />delivering the same personally to the holder of such permit, or to his or its <br />manager or agent, or person in charge of such public dance hall, if either of <br />them can be found. If the holder of such permit, or such manager or agent, or <br />person in charge of such cub!lc dance hall cannot after due diligence be found <br /> <br /> <br />
