<br />AN ORDINANCE 0F THE CITY OF SANTA ANARESTRICTING
<br />THE S~T.~ OF CONTRACEPTIVES AND CERTAIN PROPHYLACTICS,
<br />AND PRESCRIBING PENALTY FOR VIOLATION OF
<br />
<br /> THE COUNCIL OF THE CITY OF SANTA ANA DO ORDAIN AS FOLLOWS:
<br />
<br /> S.ECTI.0.N 1: It shall be unlawful for any person, firm or corporation,
<br />other than a duly licensed physician, surgeon or doctor of osteopathy, or a
<br />duly licensed wholesale druggist or retail druggist, required by law to be or
<br />have in his or its employ one or more registered pharmaclzts,to sell, offer for
<br />sale, give away or otherwise dispose of any article, thing, device, apparatus,
<br />compound, substance or medicine _designed, labeled., marked, advertised, manufacture
<br />or compounded for' use as or capable of being used for the prevention of conception
<br />or for the prevention of or treatment of any venereal disease.
<br />
<br /> SECTION 23 Any person who violates any provision of this ordinance
<br />shall be guilty of a misdemeanor and upon conviction thereof, shall be punished
<br />by a fine of not more than Three Hundred ($$00.00) Dollars or by imprisonment
<br />for a period of not more than three (3) months or by both such fine and
<br />imprisonment.

<br /> ~ SECTION 3: If any section, subsection, sentence, claus e or phrase of
<br />this or~.~."~nance is, for any reason held to be unconstitutional, such decision shal~
<br />not affect the validity of the remaining portions of this ordinance. The Council
<br />hereby declares th~%t it would have passed this ordinance, and each section,
<br />subsection, sentence, clause and phrase thereof, irrespective of the fact that
<br />any one or more other sections, subsections, sentences, clauses or phrases be
<br />declare~ unconstitutional.
<br />
<br /> SECTION 4: The City Clerk shall certify to the passage of this
<br />Ordinance and shall~cause the same to be published in three consecutive issues
<br />of the ORANGE COUNTY REPORTER, a daily new~spape~' printed, published and circulated
<br />in the City of .Santa Aha, and hereby designated for that purpose,, and thirty (30)
<br />days thereafter shall take effect and be in force.
<br />
<br /> PASSED AND ADOPTED by the Council of the City of Santa Aha at its
<br />regular meeting held on the 2nd day of December, 1935.
