<br />AN ORDINANCE OF THE CITY OF SANTA ANA, GRANTING
<br />TO SOUTHERN PACIFIC RAILROAD COMPANY, A CORPORATION,
<br />AND SOUTHERN PACIFIC COMPANY, A CORPORATION~ ITS
<br />LESSEE, THEIR SUCCESSORS AND ASSIGNS, THE RIGHT TO
<br />CONSTRUCT, RECONSTRUCT, MAINTAIN AND OPERATE THEIR
<br />RAILROAD TRACKS UPON AND ACROSS SECOND STREET AND
<br />EVERGREEN STREET IN THE CITY OF SANTA ANA.~
<br />
<br />THE CITY COUNCIL OF 'J.'.~L~ CITY OF SANTA ANA DO ORDAIN AS FOLLOWS:
<br />
<br /> $,ection 1. That the right, privilege and ~ranchise be and the same is hereby
<br />granted to the Southern Pacific Railroad Company~ a corporation~ and Southern Pacific
<br />Company, a corporation, its lessee, their successors and assigns, to constrUct~
<br />
<br />reconstruct, maintain and operate for a period of twenty-five (~5) years their standard
<br />
<br />EauEe railroad tracks with necessary turnouts ~and switches upon and across ~econd Street
<br />
<br />and Evergreen Street in the City of Santa Ana, described as
<br />
<br />"Tra.c,t No. 1.
<br />
<br /> "Begi~tm~ at a point in the present constructed track
<br />of the Southern Pacific Railroad Company, said point being
<br />in the south line of 2nd Street distant east thereon 307
<br />feet, more or less, from the east line of Evergreen Strset;
<br />thence northwesterly along an eleven degree curve concave
<br />to the south, 1~7 feet, more or less, to a point in the cen-
<br />ter line of 2nd Street; thence west along the center line
<br />of 2nd Street~ tangent to the aforesaid curve 7§5 feet~ more
<br />or less, to a p~int 3 feet, more or less, east from the
<br />southerly prolongation of the east line of Garfield Street,
<br />said Doint being the end of ~rack~

<br />.... "Beginning at a point in the cefiter line of Tract No. 1,
<br />distant west thereon 5 feet~ more or less~ from the northerly
<br />prolongation of the west line of Evergreen Street; thence
<br />northeasterly along an irregular curve concave to the north~
<br />across the north half of Second Street and its intersection
<br />with Evergreen Street, 168 feet, more or less~ to a point in
<br />the north line of Second Street distant east thereon 10S feet~
<br />more or less~ from the east line of Evergreen Street; thence
<br />across private property.

<br /> ~eg~uing at a point iu the center line of Tract No. 1~
<br /> distaut west thereon 133.5 feet, more or less~ from the northerly
<br /> prolongation of the west line of Evergreen Street; thence north-
<br /> easterly along an irregular curve concave to the north, across
<br /> the north half of Second Street a~d across Evergreen Street, 194
<br /> feet~ more or less~ to a point in the east line of Evergreen
<br /> Street, distant north ~mer~on 4.5 feet, more or less, from the
<br /> north line of Second Street; thence across private property."

<br />~ection 2e That the'line of their sa~d tracks across the said streets herein-
<br />
<br />before named shall conform in all cases to the established ~es of said streets where
<br />
<br />such grades~ before the same shall be lat~ have been established; and in all other cases
<br />
<br />the said tracks shall conform as nearly as practicable to the natural grades of the
<br />streets over and across which they may be constructed~ and when at any time any portion
<br />of said streets shall be graded~ paved or otherwise improved, or the gra~es or improve-
<br />
<br />merits thereof changed or altered by authority of said city, the said tracks shall be~
<br />
<br />by said railroad comDanies or their assigns, made to conform to such grades so made~
<br />
<br />changed or altered, if required by the Council of said Cttye
<br />
<br /> 'S,ection 3e It is f~rther made a condition hereof that the City of Santa Ana
<br />
<br />expressly reserves the right to grade, sewer~ pave, maca~amize~ repair, improve or alter
<br />
<br />said streets or any part thereof, and to use said streets for any public purpose~
<br />including the right to lay down pipes for water, gas, or other purposes therein. The
<br />
<br />grantees herein shall use the rights herein granted in a manner~ to injure or obstruct th~
<br />
<br />street and crossings as little as possible. The tracks shall be kept constantly in
<br />
<br />repair by grantees in and along said streets and at all crossings flush with the streets
<br />
