0RDINANC~ ,NO. ,~0~§ <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA <br />CREATING A MAJOR DISASTER EN~RGENCY <br />PLAN FOR THE SAFEGUARDING OF LIFE, HEALTH <br />AND PROPERTY, <br /> <br />T~E COUNCIL OF THE CITY OF SANTA ANA DO ORDAIN AS FOLLOWS .' <br /> <br /> SECTION !: That pursuant to the provisions of "AN ACT TO PROVIDE FOR <br />THE ORGANIZATION, INCORPORATION AND GOVERN~NT OF MUNICIPAL CORPORATIONS", which <br />act provides that in the event of great public cal-m~ty such as extraordinary <br />fire, flood, storm, epidemic or other disaster, the City Council may declare and <br />determine that public interest and necessity demands the immediate expenditure of <br />public money to safeguard life, health and property, and that thereupon they may <br />proceed to expend or enter into contracts involving the expenditure of any sum <br />of money required in such emergency, there is hereby created a Santa Aha Emergency <br />Relief Committee, which committee shall be constituted, have the power, and <br />perform the duties hereinafter provided for when a declared public calamity or <br />disaster exists within this city. <br /> <br /> SECTION 2: Whenever a public calamity or other disaster exists within <br />the City of Santa Aha the Mayor of the City of Santa Ana is hereby given the <br />power and author2ty to declare that such disaster or calamity exists, and as soon <br />thereafter as possible the City Council shall meet in special session and the <br />declaration of such Mayor that a disaster or calamity exists shall constitute a <br />call for the immediate convening of a special emergency meeting of the City <br />Council at the Council Chambers, or at such other place as may be designated by tb <br />Mayor, and thereafter, until the termination of the emergency by a resolution of <br />the City Council, the,City Council shall be, and shall be deemed to be in continuo' <br />~ession,_at said place or other place similarly designated by the Mayor, and <br />shall have power to function at any time a quorum of said Council shall be present <br />Upon first convening in the special emergency session of the City Council, it <br />shall be the duty of the City Council to pass a resolution by a four-fifths vote <br />confirming the act of the Mayor in declaring the emergency, and declaring the <br />calamity or disaster to exist, and the City Council does hereby ratify and <br />approve any and all acts of the Mayor in such an emergency.pending the first <br />special emergency meeting. <br /> <br /> In the event of the absence or inability of the Mayor to act when such <br />an emergency exists, then the Director of the Department of Public Safety (as <br />prescribed in Ordinance No. lOV6 of the City of Santa Aha) shall have the same <br />powers and duties as the Mayor of the City. <br /> <br /> After the declaration of an emergency resulting from public calamity <br />or disaster, the Mayor shall have the power to obligate the City of Santa Ana <br />for the payment of any and all supplies, equipment, materials, food, services <br />or other necessities of llfe that may be necessary for the purpose of alleviating <br />suffering of citizens or inhabitants of this City, and for the purpose of pro- <br />tecting such citizens or inhabitants from hardships, or property damage or loss, <br />which may be anticipated in case such condition arises, and it shall be the duty <br />of the City Council of the City of Santa Ana to confirm and ratify the acts of <br />the Mayor acting during the condition of emergency in the absence of a previous <br /> <br /> <br />
