2f 0 <br /> <br />ORDINANCE NO. 1117 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA <br />AUTHORIZING ENERGENCY SUSPENSION OF ALL <br />BUILDING, ELECTRICAL, AND PLUNBING ORDINANCES, <br />AUTHORIZING THE USE OF SUBSTITUTE NATERIALS <br />AND NETqODS DURING THE PERIOD OF NATIONAL <br />EMERGENCY, AND DECLARING AN ENERGENCY <br /> <br /> WHEREAS, a state of war exists between the United States of America <br />and Germany, Japan, and Italy and a National Emergency exists, and <br /> <br />WHEREAS, war program requirements have created a shortage of iron, <br />steel, brass, bronze, and other critical materials for war and private use, and <br /> <br /> WHEREAS, necessary restrictions on the use of these materials have been <br />and will be imposed by the Federal Goverment in such a way as to Make it <br />impossible to secure or use all of the types, sizes, or forms of materials or <br />the specifications for such materials now required by the building, electrical <br />or plumbing ordinances of this city, and <br /> <br /> WHEREAS,it is imperative that constructlo~, reconstruction, alteration <br />and repair of buildings continue during the National Emergency and the Federal <br />government has suggested that city building, electrical, and plumbing ordinances <br />be suspended during this Emergency so as to permit the substitution of available <br />materials, installations or methods of construction while at the same time fully <br />protecting the public health, safety, and general welfare, <br /> <br /> NOW, THEREFORE, THE CO[~CIL OF THE CITY OF aANTA ANA DO ORDAIN AS <br /> <br />FOLr~WS: <br /> <br /> SECTION L: SUSPENSION OF CODE AND ORDINANCE PROVISIONS DURING NATIONAL <br />ENERGENCY. For the period of the National Emergency created by the present <br />existing state of war between the United States of America and Germany, Japan, <br />and Italy the Building Inspector of the City of Sarma Ana may grant permits <br />allowing the substitution of specified building, electrical, and plumbing <br />materials and methods of construction for the materials and methods now required <br />by any ordinance of the City of Santa Aha, whenever he shall find the following <br />facts to exist: <br /> <br /> (1) The materials required by said ordinance are not available, or <br />cannot be obtained within a reasonable time, or cannot be obtained except at a <br />prohibitive cost Because of the National Emergency, and <br /> <br /> (~) The use of such substitute materials or methods will <br /> <br />increase the fire, health, or safety hazard, nor materially lessen <br /> <br />stability of the building or structure for which said substitute is to be used. <br /> <br /> SECTION 2: RULES AND REGULATIONS. The Building Inspector may prescrib, <br />rules and regulations governing applications for permits to use substitute <br />materials and methods under this Ordinance, and he may require the furnishing of <br />any information reasonably necessary to enable him to determine whether such <br />applications come within the terms of this Ordinance. <br /> <br /> SECTION 5: FINDINGS TO BE IN WRITING AND FILED. In each case where <br />the Building Inspector allows t~e use of substitute materials he shall file as a <br />part of the city's records on such permit a written statement of the facts upon <br />which he based his determination that the requirements of Section i of this <br /> <br />not materially <br />the structural <br /> <br /> <br />
