full and complete access to all records he may have for the identification and
<br />registration of bicycles within said City of Santa Ana.
<br />
<br /> Section 10: It shall be the duty of every person, firm or corporation
<br />dealing in bicycles in the City of. Santa Ana, County of Orange, State of Californt~
<br />either as a business or as an occasional buyer and seller of the same, ~ keep
<br />at his place of business a record of all bicycles bought, sold or rented by him,
<br />giving an accurate description of such bicycle and from whom received, together
<br />with his address, the factory number of the bicycle and the serial number thereof,
<br />if any, also to whom sold or rented, giving their names and addresses and the
<br />munber of the identification plate and identification card, if any, together with
<br />the date of such transaction, this record to be kept in a plain and legible
<br />handwriting in a well-bound uniform book, which shall at all times be open to
<br />the inspection of the P~lice Department of the City of Santa Ana.
<br />
<br /> Section 11: It is hereby declared unlawful, after the passage and
<br />approval and going into effect of this ordinance, for any person, acting either
<br />for himself or any other person, to change the factory or serial number on any
<br />bicycle, or to remove or to permit the removal of the identification plate from
<br />same, or to use any bicycle upon the streets, alleys, courts or public places in
<br />the City of Santa Ana without the same being registered as herein provided for
<br />in Section 4 and h~ving had issued to him and placed upon the bicycle the ident-
<br />ification plate of the current year, or to use any bicycle without the said
<br />identification plate of the current year being displayed thereon in the place
<br />provided for in Section 4 hereof, or to fail or refuse to make said application
<br />and register the same.
<br />
<br /> Section 12: It shall be unlawful for any person to operate, drive or
<br />ride any bicycle upon the streets or public highway of the City of Santa Ana
<br />between the hours commencing one-half hour after sunset and ending one-half hour
<br />before sunrise, without a lighted light on the front of sat.d bicycle capable of
<br />being observed at a reasonable distance from said bicycle, and also a red reflecto~
<br />tail light on the rear thereof capable of being observed at a reasonable dist~ce
<br />from said bicycle.
<br />
<br /> Section 13: In the event any owner or person in charge or control of a
<br />bicycle or.bicycles shall fail to register the same as provided for in Section 4
<br />hereof, said owner or person shall be subject to a penalty of twenty-five cents
<br />(25~) in addition to the registration fee of fifty cents (80~). In addition to
<br />the penalty hereinabove set forth, the Police Department of the City of Santa Ana,
<br />or any of the members thereof, or the City Clerk, may impound and retain possessio~
<br />of any bicycle operated in violation of any of the provisions of this ordin~ce,
<br />and retain possession of the same until the provisions of this ordinance are
<br />complied with and until payment of an additional penalty of fifty cents (50~)
<br />impounding fee.
<br />
<br /> Section 14: If any section, subsection, sentence, clause or phrase of
<br />this ordinance is for any reason held to be invalid or unconstitutional, such
<br />decision shall not affect the validity of the remaining portions of the ordinance.
<br />The Council of the City of Santa Aha hereby declares that it would have passed
<br />this ordinance, and each section, subsection, sentence, clause and phrase thereof,
<br />irrespective of the fact that any one or more other sections, subsections, sentenc~
<br />clauses or phrases be declared invalid or unconstitutional.
<br />
<br /> Section 15: Any person violating any of the provisions of this ordinanc~
<br />shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be
<br />punished by a fine not exceeding Three Hundred Dollars ($300.00), or by imprison-
<br />ment in the County Jail of Orange County, California, for a period of not more
<br />than ninety (90) days, or both such fine and imprisonment.
<br />
<br /> Section 16: The City Clerk shall certify to the passage and adoption
<br />of this ordinance and shall cause the same to be published in three consecutive
<br />issues of the Santa Aha Independent, a newspaper printed, published and circulated
<br />in the City of Santa Ana and hereby designated for that purpose. This o r~nsnce
<br />shall take effect January 1st, 1944.

<br /> PASSED AND ADOPTED at a regular adjourned meeting held on the 29th
