ORDINANCE NO, 1133

<br />AN ORDINANCE OF THE CITY OF SANTA ANA REPEALING
<br />ORDINANCE NO. 1100 AND AMENDING ORDINANCE NO. 658,
<br />BOTH ENTITLED "AN ORDINANCE PROVIDING FOR THE
<br />LICENSING OF BUSINESS, SHOWS, EXHIBITIONS AND GAMES
<br />CONDUCTED OR CARRIED ON IN THE CITY OF SANTA ANA,
<br />FIXING THE RATE OF LICENSE THEREFOR, AND PROVIDING
<br />FOR THE COLLECTION THEREOF".

<br />THE COUNCIL OF THE CITY OF SANTA ANA DO ORDAIN AS FOLLOWS:
<br />
<br /> Section 1: That Ordinance No. 1100 entitled "AN ORDINANCE PROVIDING FOR
<br />THE LICENSING OF BUSINESS, SHOWS, EXHIBITIONS AND GAMES CONDUCTED OR CARRIED ON
<br />IN THE CITY OF SANTA ANA, FIXInG. THE R~TE OF LICENS~ THEREFOR, AND PROVI~ NG FOR
<br />THE COLLECTION THEREOF" be, an~ the same is hereby repealed.
<br />
<br /> Section 2: That Ordinance No. 658, entitled "AN ORDINANCE PROVIUING
<br />FOR THE LICENSING OF BUSINESS, SHOWS, EEHIBITIONS AND G~fES CONDUCTED OR CARRIED
<br />ON IN THE CITY OF SANTA ANA, FIXING THE RATE OF LICENSE THEREFOR, AND PROVIDING
<br />FOR THE COLLECTION THEREOF" be, and the same is hereby amended by adding new
<br />sections thereto to be numbered Section 40a and Section 4Ob, whlchs aid sections
<br />shall be inserted in said ordinance between Sections 40 and 41 thereof, and which
<br />said sections shall read as follows:
<br />
<br /> "Section 40a: For every person, firm or corporation, either
<br />as owner, lessor, renter or consignor, conducting, managing or
<br />carrying on in any place of business the operation of any coin
<br />operated marble game or ray gun or any other machine for amusement
<br />or entertainment, for which no license is specifically provided,
<br />$40 for each machine per annum, payable in advance.
<br />
<br /> Nothing in this section shall be deemed to license any
<br />machine or contrivance or equipment which is so arranged as to
<br />permit or allow any slugs, coins or other tokens of value to be
<br />removed from the machine.
<br />
<br /> All machines for which a license to operate has been issued
<br />in the City of Santa Aha shall be marked by a non-removable license
<br />tag, label, plate or design and affixed to each machine; no such
<br />license tag, label, plate or design shall be changed from one such
<br />machine to the other.
<br />
<br /> It shall be unlawful for any person, firm or corporation to
<br />permit to be operated by the public, or cause to be placed so as to
<br />be available to the public in any place of business, any such
<br />machine unless the same bears such indication that the same has been
<br />duly licensed by the City of Santa Aha for the then current period,
<br />and it shall be unlawful for any person in charge of any place of ,
<br />business where any such machine is located to pay to any person,
<br />either in cash or ~n any other thingor things of value or in
<br />merchandise, a reward because of any indication of such machine
<br />that the player thereof is entitled to additional free games.
<br />
<br /> Notwithstanding any other provision of this ordinance, the
<br />license under this section shall not be prorated, but shall be
<br />payable annually by each licensee from the date of the issuance
<br />of the first license to any such person obtaining such license.
<br />
<br /> Section 4Ob: For every person, fi r~ or corporation, either
<br />as owner, lessor, renter or consignor, conducting, managing or
<br />carrying on in any place of business the operation of any coin
<br />operated music box, phonograph or moving picture for amusement
<br />and entertainment, SB for each machine per annum, payable in
<br />advance."
<br />
<br /> Sectign 3: The City Clerk shall certify to the passage and adoption of
<br />this ordinance and shall cause the same to be published in three consecutive issue.

<br />City of Santa Ana and hereby designated for that purpose. This ordinance shall
<br />take effect January 1, 1944.

<br /> PASSED AND ADOPTED by the Council of the City of Santa Aha at its
<br />regolar adjourned meeting held on the 29th day of November, 1943.
