<br />AN ORDINANCE AMENDING ORDINANCE NO. 658,
<br />WHICH IS AN ORDINANCE REGULATING LICENSE
<br />FEES IN THE CITY OF SANTA ANA
<br />
<br />THE COUNCIL 0F THE CITY OF SANTA ANA DO ORDAIN AS FOLLOWS
<br />
<br /> Section 1: That Ordinance No. 688 entitled "An Ordinance Providing for
<br />the Licensing of Business, Shows, Exhibitions and Games Conducted or Carried on
<br />in the City of Santa Ana, Fixing the Rate of License Therefor, and Providing for
<br />the Collection Thereof", be and the same is, hereby amended by repealing Section
<br />73, and amending Sectians~ll, I?A, 24, 40 40A, 4OB, 48, 48, 75, 86, 89A, 90, 91
<br />and 92, and adding new Sections 101 and 102, which said sections shall read as
<br />follows:
<br />
<br /> "Sec. 11: For every person, firm or corporation conducting, managing o2
<br />carrying on the business of building and loan or finance association or escrow
<br />office or examining, searching or investigating titles to real estate and issuing
<br />abstracts, statements or certificates showing or purporting to show or certify
<br />to the condition or state of the title to any particular property or properties
<br />as disclosed by an examination of the public records, but which abstract,
<br />statement or certificate does not insure the title to real property or any intere~
<br />therein, $12.50 per quarter.
<br />
<br /> Sec. 17A: It shall be unlawful for any person, firm, corporation or
<br />association to sell, dispose of or offer for sale at public auction, or to cause
<br />or permit to be sold, disposed of or offered for sale at public-auction in the
<br />City of Santa Ana, California, any platinum, gold, silver or plated ware,
<br />precious stones or semi-precious stones, watches or other Jewelry, or furniture,
<br />rugs or other house furnishings, whether the same shall be their own property or
<br />whether they shall sell the same as agents or employees of others, except
<br />Judicial sales or those made by executors or administrators of the estates of
<br />decedents~ and excepting also sales made at public auction of the stock on hand
<br />of any person or persons or corporation that shall for the period of one year
<br />next preceding such sale ~ave been continuously in business in the City of Santa
<br />Ana, California, as a retail or wholesale merchant; provided that in the latter
<br />case, before such merchant may hold an auction, he must obtain a permit therefor,
<br />which shall be applied for and issued in the following m~uer: Said merchant
<br />shall, not less than fifteen (18), nor more than thirty (80) days previous to
<br />conducting such sale, make a written application therefor under oath to the City
<br />Co~ucil specifying the name and address of the applicant, the location and
<br />purpose of the sale and its eXPected duration and itemizing in detail the quantit'
<br />quality, kind or grade of each item of goods, wares and other articles to be sold
<br />the wholesale market value thereof, and the hams of the auctioneer who shall
<br />conduct the sale. The application shall then be investigated by the Chief of
<br />Police and a report made thereon by him to the City Council as to the character
<br />of the applicant and~his auctioneer, the bona fide nature of the purpose of the
<br />sale and whether the place where it is proposed to carry on said sale is a proper
<br />place. The City Council must be furnished also with satisfactory evidence that
<br />the merchandise proposed to be sold is a bona fide part of the merchant's stock
<br />in trade and not secured, purchased or brought into said place of business for,
<br />or in anticipation of, said sale. In considering the application and attending
<br />the facts, the City Council shall exercise a reasonable and sound discretion in
<br />granting or denying the permit applied for. Such sale at public auction shall
<br />be held on successive days, Sundays and legal holidays excepted, and shall not
<br />continue for more than thirty (30) days in all from the commencement of the sale,
<br />and shall be permitted only where such merchant is bona fide disposing of his
<br />stock for the purpose of retiring from business. Said auction shall be conducte~
<br />during the daytime between the hours of 9:00 A.M. and 8:00 P.M. Every person
<br />employed as an auctioneer to conduct a public auction as herein provided shall
<br />obtain a permit from the City Clerk for the purpose of conducting such public
<br />auction, and shall pay a license fee of $10 per day.
<br />
<br /> Sec. 24: For every person, firm or corporation conducting, or carrying
<br />on a circus or other similar~sk~i$ion, a license fee based upon the total
<br />seating capacity as follows: For seating capacity of 4~000 persons or more,
<br />$200 for the first day and $100 f~r each additional day, under 4,000 capacity,
<br />$100 for the first day and $~0 for each additional day.
<br />
<br /> Sec. 40: For every person, firm or corporation conducting, managing
<br />or carrying on a ferrts wheel, scenic railway, merry-go-round, swing or similar
<br />devices where a fee is charged or collected for carrying any person thereon, $10
<br />for the first day and $8 for each day thereafter.
<br />
<br /> Sec. 40A: 'For every person, firm or corporation, either as owner,
<br />lessor, renter or consignor, conducting, managing or carrying on in any place of
<br />business the operation of any coin operated~w~bl~ game or ray gun or any other
<br />machine for amusement or entertainment, for which no license is specifically
<br />provided, ~ for each machine per annum, payable in advance.
<br />
<br /> Nothing in this section shall be deemed to license a~y machine or
<br />Contrivance or equipment which is so arranged as to permit or allow any slugs,
<br />coins or other tokens of value to be removed from the machine.
<br />
<br /> All machines for which a license to operate has been issued in the City
<br />of Santa Ana shall be marked by a nonremovable license tag, label, plate or
<br />design and affixed to each machine; no such license tag, label, plate or design
<br />shall be changed from one such machine to the other.
<br />
<br /> It shall be unlawful for any person, firm or corporation to permit to
<br />be operated by the public, or cause to be placed so as to be available to the
<br />public in any place of business, any such machine unless the same bears such
<br />indication that the same has been duly licensed by the City of Santa Ana for the
<br />then current period, and it shall be unlawful for any person in charge of any
<br />place of business where any such machine is located to pay to any person, either
<br />
