ORDINANCE NO. 1145 <br /> <br />AN ORDINANCE REPEALING SECTION ll E OF ORDINANCE <br />NO. 1023 AND ADDING NE~V SECTIONS ll E AND ll D of <br /> ORDINANCE NO. 984. <br /> <br />THE COUNCIL OF THE CITY OF SANTA ANA DO ORDAIN AS FOLLOWS: <br /> <br />SECTION l: That Section llE of Ordinance No. 1023 of the City of Santa Ana be <br /> <br />and the same is hereby repealed and new sections llE and llD are hereby added to <br /> <br />Ordinance No. 984 to read as follows: <br /> <br /> "SECTION liE: It shall be unlawful for any person owning or having <br />charge, care or control of any dog, to keep the same unconfined or un- <br />restrained upon any premises within the corporate limits of the City of <br />Santa Ana, or to allow the same to run at large within the corporate <br />limits of said City after such dog has been declared to be a public <br />nuisance as herein provided. When written complaint has been made by <br />any person or by any peace officer to the City Poundmaster that any dog <br />within the limits of said City is a nuisance by reason of barking, howl- <br />ing, growling, running or charging at or after any person or vehicle or <br />destroying or molesting publiq or private property or roaming or running <br />at large upon public or private property' or for any other reason affect- <br />ing public peace, health, security, safety, quietude or welfare, such <br />dog may be declared by the City Poundmaster to be a public nuisance. <br />Said written complaint or declaration shall give the name of the owner <br />of the dog and the time and place where the nuisance was committed. <br />Written notice of said complaint or declaration shall be delivered by <br />the City Poundmaster to the person or persons owning or having charge or <br />control of such dog. Such complaint or declaration shall state the <br />ground or reason for such dog being declared a nuisance. If such dog be <br />declared to be a nuisance because of its barking or howling, the owner or <br />owners of said dog, or person or persons having care, charge or control <br />thereof, shall thereafter keep said dog securely muzzled or take other <br />appropriate steps to prevent said dog from barking or howling. If such <br />dog be declared to be a nuisance on any other ground specified in this <br />section, the owner or owners of such dog, or person or persons having <br />care, charge or control thereof, shall thereafter keep said dog securely <br />tied or kept in an enclosure on the premises of such person, or kept on <br />leash. Any such dog kept in violation hereof after such declaration and <br />notice may be seized and destroyed by the Poundmaster. <br /> "Section llD: It shall be unlawful for any person owning, having <br />charge, care or control of any dog, to allow the same to be in any auto <br />court or park, used or rented for auto trailer houses, within the <br />corporate limits of Santa Ana, without being confined on leash." <br /> <br />SECTION 2: The City Clerk shall certify to the passage and adoption of this <br /> <br />Ordinance and shall cause the same to be published in thr~e consecutive issues of the <br /> <br />Santa Ana Register, a newspaper printed, published and circulated in the City of Santa <br /> <br />Ana, and hereby designated for that purpose.
