ORDINANCE NO. 1165 <br /> <br /> AN 0RDINANCE'0F~THE cITT OF SANTA ANA GRANTING <br /> TO SOUTHERN PACIFIC RAILROAD COMPANY, A CORPORATION, <br /> AND SOUTHERN PACIFIC COMPANY, A CORPORATION, ITS <br /> LESSEE, TNEIR ~UCCEE20RE AND A~2IGNg, TNE ~IGNT TO <br /> CONSTRUCT, RECONSTRUCT, NAINTAIN AND OPERATE STANDARD <br /> GUAGE RAILROAD TRACKS IN AND ACROSS FOURTH STREET IN <br /> THE CITY OF SANTA ANA. <br /> <br />The City Council of the City of Santa Ana do ordain as follows: <br />Section 1. That the right, privilege and franchise be and the same is <br />hereby granted to the Southern Pacific Railroad Company, a corporation, and <br />Southern Pacific Company, a co~poration, its lessee, their successors and assigns, <br />to construct, reconstruct, maintain and operate for a period of twenty-five years <br />their standard guage railroad tracks upon and across Fourth Street in the City of <br />Santa Ana, described as follows: <br /> <br /> Railroad tracks as now constructed in, upon, over and across <br /> Fourth Street, 80 feet wide, in the City of Santa Ana, County <br /> of Orange, State of California, the center lines of said <br /> tracks being described as follows: <br /> <br /> Track No. 1. <br /> <br /> Beginning at a point in the Southerly line of said Fourth Street, <br /> distant Easterly thereon 155.V feet, from the Westerly line of <br /> Breeden Street, 60 feet wide; thence Northwesterly along the <br /> arc of a curve, concave Southwesterly, and having a radius of <br /> @19.02 Feet, a distance of 84.8 feet, to a point in the northerly <br /> line of said Fourth Street, distant Easterly thereon 1~8.4 feet, <br /> from its intersection with the Northerly prolongation of said <br /> Westerly line of Breeden Street. <br /> <br /> Track No. 2.. <br /> Beginning at a point in the Southerly line of said Fourth Street, <br /> distant Easterly thereon 133.? feet, from the Westerly line of <br /> said Breeden Street; thence Northwesterly along the arc of a <br /> curve, concave Southwesterly, and having a radius of 392.61 feet, <br /> a distance of 82.9 feet, to a point in the Northerly line of said <br /> Fourth Street, distant Easterly thereon ll~.~ feet, from its <br /> intersection with the Northerly prolongation of said Westerly <br /> line of Breeden Street. <br /> <br /> Section 2. That the line of their said tracks across the said street <br />hereinbefore named shall conform in all cases to the established grade of said <br />street where such grade, before the same shall be laid, has been established; <br />and in all other cases the said tracks shall conform as nearly as practicable to <br />the natural grades of the street over and across which they may be constructed, <br />and when at any time any portion of said street shall be graded, paved or other- <br />wise improved, or the grades or lSprovements thereof changed or altered by authori <br />of said city, the said tracks shall be, by said railroad companies, or their <br />assigns, made to conform to such grades so made, changed or altered, if required <br />by the Council of said City. <br /> <br /> Section 3. It is further made a condition hereof that the City of <br />santa Ana expressly reserves the right to grade, sewer, pave, macadamize, repair, <br />improve or alter said street or anU part thereof, and to use aaid street for any <br />public purposes, including the right to lay do~n pipes for water, gas, or other <br />purposes therein. The grantees herein shall use the rights herein granted in a <br />manner to injure or obstruct the street and crossings as little as possible. <br /> <br />The tracks shall be kept constantly in repair by ~'ante®s in and along said street <br />and at all crossings flush with the street, and paved or improved between lines <br />two feet outside of the outside rails to conform to the pavement and improvement <br />in the balance of street; and the grantees agree to provide and maintain all stor~ <br />water drains and culverts under and across their tracks where necessary and when <br />required by the Council of said city. <br /> <br /> Section 4. That the grantees hereof, by the acceptance of this franchis <br />hereby agree to pay to the City of Santa Aha the expenses necessary for the <br /> <br />~y <br /> <br /> <br />
