3. That said public improvement is planned and located in <br />a manner which will be most cc~patible with the greatest public <br />good and the least private injury; <br /> <br /> 4. That said action in condemnation shall be taken in <br />accozdance with the provisions of the Code of Civil Procedure and <br />the Constitution of the State of California relating to eminent <br />domain; <br /> <br /> 5.
