RESOLUTION 63 ~155 APPROVING RAP AND DECLARING <br />INTENTION TO VACATE A PORTION OF STR~;~' RUNNING <br />BETWEEN FIRST AND SECOND STRE~£'S ALONG THE WEST <br />LINE OF THE SOUTHerN CALIFORNI~ RAILWAY DEPOT <br />GROUNDS ~/ID a SECTION OF SECOND STR~£' RUNNING <br />FROM SAID WEST LINE EASTerLY TO THE TR~CK OF SaID <br />R~ILWAY COMPANY, S~ID STR~.~3f BEING WHOLLY UNIMPROVED <br /> <br /> WH~E~S, in 1893 a certain street easement, herein described, <br />was dedicated to the City of Santa Ana but was never improved or <br />opened to public use, and, in the process of negotiating with the <br />Atchison Topeka and Santa Fe Railway Company for the establishment <br />of separation of grade at the crossing of its tracks on First Street, <br />the Department of P~blic Works has requested that the streets herein <br />described be vacated to prevent street access to First Street in <br />this area. <br /> <br /> NOW, TEW~EFORE, BE IT RESOLVED: That the map attached hereto <br />marked Exhibit "A" is hereby approved and ordered filed with and as <br />a part of this Resolution in the office of the Clerk of the Council, <br />and reference is hereby made to said map for particulars as to the <br />street vacation proposed herein; and the City Council hereby declares <br />its intention to vacate that portion of Second Street and that portion <br />of an unnamed street running between Second Street and First Street <br />in the City of Santa Ana, County of Orange, State of California, <br />described as follows: <br /> <br />Commencing at the intersection of the center line of <br />Second Street extended with the West line of the Southern <br />California Railway Depot grounds in the City of Santa aha, <br />thence East at a uniform width of sixty feet, thirty feet <br />on each side of said center line extended, to the track of <br />the railroad of the said Southern California Railway Company. <br /> <br />also a strip of land sixty feet in width, commencing on the <br />South line of Second Street nearly opposite to the track <br />scales located on the "Y" of said Railway Company in said <br />City of Santa Cna, and extending Southerly in a uniform <br />width of sixty feet to First Street, in said City of Santa <br />ana) both of said lines being shown by dotted lines on the <br />map on file in the Office of the City Clerk, City of Santa <br /> <br />Said easement being the land described in that particular <br />agreement between the City of Santa dna and the Southern <br />California Railway Company recorded March 13, 1893, in <br />Book'82, Page 108, Deeds, Orange County Records. <br /> <br /> BE IT FURT~RESOLVEDTHAT: The hour of 7:30 P.M. on the <br />7th day of October, 1963, in the Council Chambers, City Hall, Third <br />and Main Streets, Santa Ana, California, is the time and place fixed <br />for hearing ail persons interested in or objecting to the proposed <br />vacation of said street. <br /> <br /> The City Council declares its intention to proceed with this <br />street vacation under the provisions of the Street Vacation Act of <br />1941 (Sections 8300 through 8374 of the California Streets and High- <br />ways Code). <br /> <br /> The Clerk of the Council is ordered to publish this Resolution <br />in the manner prescribed by law for the publication of ordinances of <br />the City, and the Director of Public Works is ordered to post notices <br />of street vacation conspicuously along the line of said street, <br />stating the passage of this Resolution of Intention to Vacate and the <br />time and place of hearing thereof. Said notices shall be posted not <br />more than 300 feet apart and at least three shall be so posted. Both <br />publication and pust~ng shall be completed at least 10 days before <br />the date of said hearing. <br /> <br />Resolution 63-131 is hereby rescinded. <br /> <br /> <br />
