RESOLUTION 63-181 OVERRULING THE PLANNING <br />COMMISSION AND GRANTING A VARIANCE ON <br />VARIANCE APPLICATION NO. 1826 FILED BY <br />CLARA EDITH VOSE, SUBJECT TO CONDITIONS <br /> <br /> WHEREAS, a~ter hearing on no, ice, %he Planning Commission <br />denied a variance on Variance Application No. 1826, filed by <br />CLARA EDITH VOSE, and Appeal Application No. 95 was filed presenting <br />the matter to the City Council; and <br /> <br /> WHEREAS, the City Council, after public hearing on notice, <br />has determined that the Planning Commission should be overruled and <br />that said variance should be granted subject to conditions as <br />rec~nmended by the Planning Commission. <br /> <br /> NOW, THF~REFORE, BE IT RESOLVED: That the City Council hereby <br />grants a variance on Variance Application No. 1826 to permit the <br />property located at the southeast corner of Bristol Street and Memory <br />Lane, in an R-1 District, to be used for the construction of a <br />service station. Said Variance is granted subject to the following <br />conditions: <br /> <br />That a 6-foot solid block wall be constructed along the <br />entire east and south boundaries of the service station <br />site, excepting that said wall be 3 feet in height within <br />10 feet of the street right of way. <br /> <br />That a complete landscaping plan for the station site be <br />submitted to and approved by the City Planning Department; <br />said plan to include: <br /> a. 5-foot planters constructed on site at the locations <br /> indicated on the approved plot plan; <br /> b. The size, type and location of all plants, bushes <br /> and trees on the site; <br /> c. A 5-foot planting area along the interior of the <br /> block walls on the east and south; said areas to <br /> include trees, bushes or shrubs at least 6 feet <br /> high at time of planting and spaced not more than <br /> 10 feet apart that would grow to a height of at <br /> least 8 to 10 feet and achieve a landscaped backdrop <br /> for the station site as well as provide an <br /> aesthetically pleasing view for adjacent residences. <br /> <br />That the applicant submit full renderings of the proposed <br />station for Planning Commission approval and that the <br />station, pumps and site be constructed according to the <br />submitted design. <br /> <br />4. That all signs be non-flashing. <br /> <br />That the existing traffic signal at the intersection of <br />Bristol Street and Memory Lane be relocated and the cost <br />of said relocation be borne by the Shell Oil Company. <br />Said relocation to be determined by the Director of Public <br />Works. <br /> <br />That no outdoor storage, either permanent or temporary, <br />such as tires, trailers, bales, etc., be permitted on <br />site excepting for display racks for advertising purposes. <br /> <br />7. That all lights used in conjunction with the station be <br /> reflected away frem nearby residences. <br /> <br />8. That development as modified by the above conditions be <br /> otherwise according to the approved plot plan. <br /> <br /> <br />
