RESOLUTION 63-188 OVERRULING THE PLANNING <br />COMMISSION AND GRANTING A VARIANCE ON <br />VARIANCTM APPLICATION NO. 1845 FILED BY <br />DOXANDER P. LEONARD, ET AL., SUBJECT TO <br />CONDITIONS <br /> <br /> WHEREAS, after hearing on notice, the Planning Commission <br />DENIED a Variance on Variance Application No. 1845, filed by <br />DOXANDERP. LEONARD, ET AL., and Appeal Application NO. 108 was <br />duly filed presenting the matter to the City Council; and <br /> <br /> WHEREAS, the Clty Council, after public hearing on notice, <br />has determined that the Planning Commission should be overruled <br />and that said Variance should be granted subject to conditions as <br />recommended by the Planning Commission. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council <br />hereby grants a variance on Variance Application No. 1845 to permit <br />the property located east of Bristol Street, between Memory Lane <br />and the Santa Aha Freeway, in an A-1 District, to be used for the <br />construction of a 203-unit, one and two story apartment complex. <br />Said Variance is granted subject to the following conditions: <br /> <br />1. That the applicant comply with all provisions of the R-4 District. <br /> <br />2. That the applicant submit a revised plan of the project; said <br /> revised plan to show: <br /> <br />A plot plan with not more than 199 units (the deletion of <br />4 units in the locations outlined in the latest revised <br />plot plan on file at time of hearing with Planning <br />Department). <br /> <br />b. ~nergency access areas to the west end of West Orange Road <br /> and to future Westwood Street. <br /> <br />The development timing or phasing,unless the applicant <br />wishes to construct the entire project at one time. Said <br />construction order shall be approved by the Planning <br />Director in order to assure the following features within <br />the project: <br /> <br />1. Adequate vehicular circulation into, around and <br /> through the project by emergency vehicles. <br /> <br />2. Adequate ingress-egress frc~ Bristol Street for <br /> the project. <br /> <br />Crash gates at the emergency access points that will <br />be functional, aesthetical and compatible to the <br />project and surrounding neighborhood. <br /> <br />4. Construction features, such as block walls, etc.,are <br /> implemented on each phase or total project. <br /> <br />d. A perspective rendering and elevation plan for each design <br /> motif in the project. <br /> <br />Se <br /> <br />That development be according to revised and approved plot plan, <br />rendering and elevations except for minor modifications approved <br />by the Planning Director. <br /> <br />That crash gates be installed across the emergency access points; <br />the detailed plans of said gates shall be filed with the Planning <br />Department and shall include the signed approval of the City Fire <br />Chief or his representative. Said gates shall be so designed, <br />erected and maintained by the applicant so as to deny all <br />pedestrian and vehicular access except for emergency service to <br />the site by proper officials. <br /> <br /> <br />
