(MIG) is pleased to submit this proposal to the City of Santa Ana for amendments <br /> to the current Zoning Code, in advance of the comprehensive update, that will address <br /> industrial uses within SD-84 (Transit Zoning Code, Article XIX of Title 41, Santa Ana <br /> Municipal Code). While some of the work will be required as part of the current scope and <br /> budget in the agreement for the Comprehensive Zoning Code Update, prioritizing this <br /> focused amendment to be completed before the Comprehensive Zoning Code Update will <br /> involve additional work and meetings/coordination with City staff not included in the current <br /> scope and budget. This proposal identifies all work to be completed for this advanced task. <br /> Per our discussions, any overlap with existing tasks will be resolved at a future date. Thus, <br /> the scope and not-to-exceed fee in this proposal is inclusive of all work described herein <br /> and will be billed as part of this project. <br /> The services to be provided are as follows: <br /> 1. Prepare an ordinance that: a) eliminates the text referencing the overlay district <br /> applicable to SD-84 (with City staff providing any required map amendment), b) <br /> includes zoning text amendments to permit specific uses in the desired areas (to <br /> allow specific types of businesses to relocate from or remain in the SD-84 area), and <br /> c) incorporates the following: <br /> • Establishing a procedure to address amortization provisions for current industrial <br /> uses, as determined by staff <br /> • Establishing the rights of nonconforming industrial uses <br /> • Establishing operational standards for nonconforming industrial uses (air quality, <br /> noise, truck traffic, others) <br /> • Revising the existing Transit Zoning Code use matrix to allow additional non- <br /> industrial business activities <br /> 2. Meet with City staff on a bi-weekly basis, or as needed subject to mutual agreement, <br /> to keep the work on schedule, with meetings to include the City Attorney's office as <br /> needed (via teleconference). <br /> 3.
