In consideration of the foregoing,. GARDEN GROVE will, upon -demand <br />12 by SANTA ANA, seek review of that decision by <br />court of competent <br />13 jurisdiction. For purposes of this agreement, a decision of a - <br />14 court of competent jurisdiction shall mean a final decision on the <br />15 merits b the Court of Appeal ppeal, or a refusal by the Court of Appeal <br />16 to review a final decision of the Superior Court. <br />17 10. The parties contemplate that the first year assess- <br />$ ment reduction to GARDEN GROVE will be approximately 80% of the <br />39 1973-74 assessment. In the evert that the Tax.Assessor does not, <br />20 prior to August 1, 1974, agree to reassess the Willowick property <br />21 for the assessment year 1974-75, to an amount at least 75% below <br />22 the 1973-74 assessment, GARDEN'GROVE has the option to accept <br />23 that assessment, or to seek review of the assessment by a court <br />24 of competent jurisdiction as defined above,. or to sell the three <br />25 <br />parcels to SANTA ANA at a price of $90,000,.and SANTA ANA agrees <br />26 <br />to purchase same at that price. <br />27 <br />11.
