CITY's share of design, survey and construct�.on '�rgineering costs <br />shall be the actual costs accrued to the CIT, portion based on the <br />percentage of the total contract unit costs billed to CITY. <br />VI. Upon completion of the Project, COUNTY agrees to submit full, true <br />and correct copies of documents, certificates and itemized bills to <br />CITY and CITY shall reirnburse COTJWFf within ninety (90) days upon <br />submission of startement of such costs for the CITY portion of the <br />construction as defined by paragraphs IV, V, and VI hereof. Such <br />bills shall be based on the actual quantities of construction and <br />the contract bid prices, and shall include a charge for overhead on <br />the engineering and inspection performed by COUNTY. <br />VII. It is mutually understood that Project will be financed with TOPICS <br />funds. CITY hereby authorizes transfer of $5,140 more or less in <br />CITY TOPICS funds to COUNTY for 'CITY's TOPICS portion of Project. <br />VIII. The total cost to CITY is presently estimated to be $7,130 and the <br />total cost to CO-ONTY is presently estimated to be $27,370. <br />IX. It is mutually agreed by the parties hereto that: <br />A. COUT11TY shall maintain said System and P-11 traffic signls therein. <br />B. The maintenance and operational costs for said System and traffic <br />signal and intersection lighting installation shall be borne by <br />the parties hereto in accordance with the terms of the traffic <br />signal and highway lighting maintenance agreement No. 369-313. <br />C. That neither COUNTY nor any officer or employee thereof shall be <br />responsible for any damage or liability occurring by reason of <br />any -thing done or omitted to be done by CITY under or in connection <br />with any work, authority or jurisdiction delegated to CITY under <br />this agreement. It is also understood and agreed that, pursuant <br />to Government Code Section 895.4, CITY shall fully indemnity and <br />hold COUNTY harmless from any liability imposed for injury (as <br />defined by Government Code Section 810.8), occurring by reason <br />of any -thing done or omitted to be done by CITY under or in connectic <br />-3- <br />FOS01118 <br />
