Bristol St.) <br />and Staff Resolution Modifying Parking Districts in the Surrounding Area <br />October 1, 2024 <br />Page 6 <br />The Second refinement is for the purpose of advancing the development of the open <br />space on the Project Site. The Applicant is proposing to refine the Agreement to clarify <br />and provide the applicant the ability for early development of the open space proposed <br />in Phase III as part of an earlier Phase (i.e. Phase II) without triggering the payment of <br />the final $8 million community benefit payment. The refinement is a positive investment <br />and further commits the applicant to completing the project. <br />Both refinements do not modify the substance of the Agreement as recommended by <br />the Planning Commission and have been included in the draft Development Agreement <br />attached as Exhibit 8.
