RESOLUTION NO. 61-217 PROVIDING FoR THE WITH- <br />DRAWAL OF CERTA~ TERRITORY FROM THE GARDEN <br />GROVE FIRE PROTECTION DISTRICT <br /> <br /> WHEREAS, an inhabited annexation proceeding was conducted <br />by the City of Santa Ana, California, under the name of "West Santa <br />Ana Annex", at the election held under said proceeding the electors <br />in the territory affected voted in favor of said annexation, but <br />said proceeding was challenged by two cases in the Superior Court <br />of Orange County and the annexation was held in abeyance during the <br />appeals of said two cases, which were designated 4th Civil No. 6290 <br />and 6391, and were finally determined by the District Court in <br />favor of said annexation and approved the same, and the Remittitur <br />from District Court of Appeal, Fourth Appellate District, State of <br />California, was filed on the 24th day of February, 1961, in the <br />office of the County Clerk and the Clerk of the Superior Court of <br />the State of California in and for the County of Orange, and from <br />and after said date said territory became and still is a part of the <br />City of Santa Ana, California; and <br /> <br /> WHEREAS, said territory included most of Westminster Avenue <br />(Seventeenth Street in Santa Ana) and along the Northerly half of <br />Westminster Avenue from Verano Street East to a point 330 feet East <br />of Newhope Street, except between Anita and Rosita Streets the street <br />right of way was included within the Garden Grove Fire Protection <br />District; and <br /> <br /> WHEREAS, said included area is now afforded fire protection <br />by the City of Santa Ana; said City maintains an excellent Fire <br />Department, well staffed and equipped with the most modern fire <br />fighting equipment and devices so that said City has been rated a <br />Class 3 by the Underwriter's Bureau evidencing the highest form of <br />fire protection available in the County of Orange, and that portion <br />of said territory along the Northerly half of Westminster Avenue <br /> <br />-1- <br /> <br /> <br />
