CITY OF SANTA ANA <br /> replacement of Contractor's personnel under the awarded contract. The City <br /> shall notify the contractor in writing of such action. The City is not required to <br /> provide any reason, rationale or additional factual information if it elects to <br /> request any specific employee be removed from performing services under the <br /> awarded contract. <br /> 2.2.5 The Contractor shall ensure sufficient staffing levels to provide the services <br /> described herein. Should Contractor personnel fail to report for this or her shift, <br /> the Contractor must provide a replacement within two hours. <br /> 2.2.5.1 Criminal Background Certification: Contractor certifies that all employees <br /> working on this contract have had a criminal background check at <br /> Contractor's cost and that said employees are clear of any sexual and drug- <br /> related convictions. Contractor further certifies that all employees hired by <br /> Contractor or Subcontractor shall be free from any felony convictions. City <br /> reserves the right to require Contractor to pay fingerprinting fees for <br /> personnel assigned to work in sensitive areas. <br /> 2.2.5.2 Standards of Conduct: Contractor's personnel shall be courteous and <br /> maintain good working relationships with all stakeholders, state or outside <br /> agencies, other team members and staff within the City. Furthermore, City <br /> locations consist of public-use facilities and recognizes the obligation to <br /> ensure Contractor personnel and agents maintain the highest level of <br /> professional standards in attire, decorum, and interaction with the public <br /> and City personnel. Contractor's personnel and agents shall comply with <br /> all City rules and regulations while on City premises. <br /> 2.3 Rules of Operation <br /> 2.3.1 Contractual Obligations: The City shall require certain contractual obligations, <br /> which may include, but are not limited to, the following: <br /> 2.3.1.1 Inclusion of proposal — The proposal shall be a required part of the final <br /> agreement with the awarded vendor. <br /> 2.3.2 Agreement: A resulting agreement shall include any written material made as <br /> part of your proposal. This material may include, but is not limited to: answers to <br /> questions contained in this RFP, addenda, letters, telegrams, facsimile, and <br /> product literature. <br /> 2.3.3 Changes to Terms and Conditions: Proposers are to submit, as part of their <br /> proposal, any changes or modifications to the terms and conditions they may <br /> wish the City to consider. Proposers are encouraged to offer any other options, <br /> with the understanding that their proposal shall first address the RFP <br /> requirements. Options are to be identified as such. <br /> 2.3.4 Errors and Omissions: Proposer shall not be allowed to take advantage of any <br /> errors or omissions in the RFP.
