CITY OF SANTA ANA <br /> 2.1.2 Contractor must comply with all applicable laws including, but not limited to, the <br /> Displaced Janitor Opportunity Act, California Labor Code, Section 1060-1065 <br /> and the Property Service Workers Protection Act, California Labor Code, Section <br /> 1420-1434 <br /> 2.1.3 Contractor must notify City within one day, via email by Contractor's assigned <br /> supervisor, of any non-emergency abnormal conditions or occurrences, <br /> including vandalized, damaged, or inoperable property. Emergency and urgent <br /> issues such as mainline breaks, water leaks, security issues and such shall be <br /> reported to the designated City representative as soon as possible. Should any <br /> City property be damaged or destroyed by the Contractor, the Contractor will <br /> bear full responsibility for repair and/or replacement, as coordinated and <br /> approved by the City. Contractor shall bear full responsibility for theft or loss of <br /> keys in their possession and shall pay cost of re-keying all locks operated by <br /> these keys. Keys must not be duplicated. <br /> 2.2 Personnel <br /> 2.2.1 The Contractor warrants that all persons employed to provide service under this <br /> contract have satisfactory past work records indicating their ability to accept the <br /> kind of responsibility required under this contract. Contractor shall provide <br /> personnel that has been trained for performance of the specified services. <br /> Contractor must provide supervision of personnel at all times. Supervisors must <br /> speak English and have been trained in supervision as well as in providing <br /> janitorial services. <br /> 2.2.2 Contractor shall provide the City's Contract Administrator or their authorized <br /> representative an accurate list of all employees who have any relationship to <br /> work performed within the scope of this contract, prior to an employee starting <br /> work on City property. Changes to the list shall be reported in writing to the <br /> Contract Administrator or his/her authorized representative within one working <br /> day. Employees terminated by the Contractor shall be reported the same day to <br /> the Contract Administrator or their authorized representative. If a Contractor's <br /> employee is terminated after normal business hours, the next business morning <br /> is acceptable. <br /> 2.2.3 Contractor personnel shall not be assisted nor accompanied by any individual <br /> that is not an employee of the Contractor while performing duties related to the <br /> contract. This includes, but is not limited to mends, children and/or other <br /> relatives. Employees of the Contractor that violate this stipulation shall be <br /> deemed objectionable to the City and shall not be allowed to work in City <br /> facilities. <br /> 2.2.4 Contractor must not allow its personnel to enter the City premises while under <br /> the influence of drugs, alcohol, nor use or possess drugs or alcohol while on City <br /> premises and performing services under this contract. Should any Contractor <br /> employee be deemed unacceptable to the City for any reason, City may notify <br /> Contractor and request the removal of the personnel involved and replacement <br /> must be provided.
