COOPERATIVE AGREEMENT NO. C-3-3087 <br /> 1 WHEREAS, the California Department of Housing and Community Development (HCD) <br /> 2 administers REAP 2.0 in accordance with Health and Safety Code sections 50515.06 to 50515.10 <br /> 3 ("Statues")and REAP 2.0 guidelines for Metropolitan Planning Organizations (MPO)applicants released <br /> 4 by HCD pursuant to the Statutes (herein referred to as "REAP 2.0 Guidelines"); and <br /> 5 WHEREAS, the Southern California Association of Governments (herein referred to as "SCAG") <br /> 6 is the federally designated MPO for Southern California; and <br /> 7 WHEREAS, on April 12, 2023, SCAG released a Call for Applications for REAP 2.0; and <br /> 8 WHEREAS, the AUTHORITY submitted on behalf of the CITY and was awarded REAP 2.0 <br /> 9 funding through SCAG for the PROJECT; and <br /> 10 WHEREAS, the AUTHORITY's Board of Directors, at its July 24, 2023, meeting, approved <br /> 11 AUTHORITY's financial commitment to the PROJECT of up to Three Million Six Hundred and Ninety <br /> 12 Thousand Dollars ($3,690,000); and <br /> 13 WHEREAS, AUTHORITY will provide Three Million Six Hundred and Ninety Thousand Dollars <br /> 14 ($3,690,000) in REAP 2.0 funds to the CITY; and <br /> 15 WHEREAS, CITY agrees to act as the lead agency for preliminary engineering, right-of-way, <br /> 16 construction and construction management of PROJECT; and <br /> 17 WHEREAS,this Agreement defines the specific terms and conditions and funding responsibilities <br /> 18 between the PARTIES for completion of PROJECT; and <br /> 19 WHEREAS,AUTHORITY and SCAG have entered into a Memorandum of Understanding (MOU) <br /> 20 regarding the administration and delivery of projects awarded REAP 2.0 funds.The MOU requires certain <br /> 21 flow-down provisions to be included in all agreements entered for this PROJECT. These provisions are <br /> 22 contained in Exhibit B to this Agreement ; and <br /> 23 WHEREAS, the AUTHORITY's Board of Directors authorized this Agreement on September 9, <br /> 24 2024; and <br /> 25 WHEREAS, CITY's City Council approved this Agreement on day of <br /> 26 2024. <br /> Page 2 of 12 <br />
