COOPERATIVE AGREEMENT NO. C-3-3087 <br /> 1 other State (California Department of Transportation) requirements. <br /> 2 D. CITY shall comply with all local and State project delivery requirements including, but not <br /> 3 limited to, Disadvantaged Business Enterprise, American with Disabilities Act, and Buy America <br /> 4 provisions. <br /> 5 E. CITY shall submit applicable National Environmental Policy Act(NEPA)and the California <br /> 6 Environmental Quality Act(CEQA)environmental documentation to AUTHORITY. <br /> 7 F. CITY shall procure in compliance with all applicable federal, state, and local laws and <br /> 8 regulations. <br /> 9 G. CITY shall coordinate with AUTHORITY to provide information to the SCAG Project <br /> 10 Manager regarding any existing solicitation for the PROJECT. Information shall be provided and a written <br /> 11 approval by the SCAG Project Manager shall be obtained. City will not advertise or award a contract <br /> 12 before SCAG authorization to proceed. <br /> 13 H. CITY shall draw down AUTHORITY's REAP 2.0 funds directly and provide expenditure <br /> 14 reports to AUTHORITY reflecting drawdown of funds and funds expended for PROJECT and consistent <br /> 15 with flow-down provisions, as identified in Exhibit B. <br /> 16 I. CITY shall prepare and submit a quarterly report per Exhibit B requirements to <br /> 17 AUTHORITY within seven (7) days of the month following the end of each quarter (April, July, October, <br /> 18 and January). <br /> 19 J. CITY shall prepare and submit invoices and all required reports to AUTHORITY in a timely <br /> 20 manner in order to avoid any penalties that could reduce funding to PROJECT. <br /> 21 K. CITY agrees that any cost overruns shall be the responsibility of CITY. <br /> 22 L. If CITY receives local, state, or federal funds from a non-AUTHORITY source, CITY will <br /> 23 not invoice AUTHORITY for the amount received from the other non-AUTHORITY source(s). <br /> 24 M. CITY will notify AUTHORITY regarding any non-AUTHORITY revenues received for the <br /> 25 PROJECT and AUTHORITY funds may not pay for expenses already supported through these non- <br /> 26 AUTHORITY revenues. <br /> Page 5 of 12 <br />
