(b) "Building Permit" means the building permit(s) issued by City and <br />required for the construction. <br />(c) "Business Day" means any Monday, Tuesday, Wednesday, Thursday or <br />Friday on which Santa Ana City Hall is open to the public to conduct City affairs. <br />(d) "Calendar Year" means each consecutive twelve (12) month period <br />from January 1 to December 31. <br />(e) "Certificate of Completion" has the meaning set forth in Article 13. <br />(f) "City" means the City of Santa Ana, California, a charter city and <br />municipal corporation. <br />(g) "City Deed of Trust" means the performance deed of trust referenced in <br />Section 4.1(e). <br />(h) "City Project Manager" shall mean the City's Housing Division <br />Manager, Homeless Services Manager and/or his/her designee. <br />(i) "County" means the County of Orange, California. <br />0) "Extremely Low Income" means an adjusted income that does not <br />exceed thirty percent (30%) of the area median income for the Orange County, California <br />PMSA, adjusted for household size, as published by HUD. <br />(k) "Extremely Low Income Household" means an individual or family <br />whose income qualifies as Extremely Low Income, adjusted for household size, as published by <br />HUD. <br />(1) "Governmental Authority" means any governmental or quasi - <br />governmental agency, board, bureau, commission, department, court, administrative tribunal or <br />other instrumentality or authority, and any public utility. <br />(m) "Grantee" means Illumination Foundation, a California nonprofit <br />corporation, and its permitted successors and assigns to all or any part of the Property, Project <br />or this Agreement. <br />(n) "Hazardous Materials" means flammable materials, explosives, <br />radioactive materials, hazardous wastes, toxic substances and similar substances and materials, <br />including all substances and materials defined as hazardous or toxic wastes, substances or <br />materials under any applicable law, including without limitation the Resource Conservation and <br />Recovery Act, 42 U.S.C. §§ 6901 et sea., and the Comprehensive Environmental Response, <br />Compensation and Liability Act of 1980, 42 U.S.C. §§ 9601, et seq., as amended. Hazardous <br />Material shall not include (i) construction products, household cleaners and office materials of <br />the type and quantity ordinarily used in the normal construction, operation, ownership, <br />occupancy and maintenance of properties similar to the Project or (ii) small amounts of <br />household mold to the extent promptly remediated upon discovery. <br />
