RESOLUTION NO. 2022-XXX <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE <br />CITY OF SANTA ANA APPROVING CONDITIONAL USE <br />PERMIT NO. 2022-06 AS CONDITIONED TO ALLOW THE <br />CONSTRUCTION OF AN ACCESSORY STRUCTURE <br />EXCEEDING FIFTEEN FEET IN HEIGHT WITHIN THE REAR <br />YARD OF THE PROPERTY LOCATED AT 2221 NORTH <br />HELIOTROPE DRIVE. <br />BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA <br />ANA AS FOLLOWS: <br />Section 1. The Planning Commission of the City of Santa Ana hereby finds, <br />determines, and declares as follows: <br />A. Chan Quang and Quynh Dinh Kieu (Property Owners), are requesting <br />approval of Conditional Use Permit (CUP) No. 2022-06 to allow the <br />construction of an accessory structure exceeding fifteen feet in height, <br />within the rear yard area of an existing single-family residence located at <br />2221 North Heliotrope Drive. <br />B. Santa Ana Municipal Code ("SAMC") Section 41-232.5 requires approval of <br />a CUP for accessory buildings more than fifteen feet in height or more than <br />one story. <br />C. The proposed accessory structure would be 21'-8" in height, requiring <br />review and approval of a CUP. <br />D. On March 28, 2022, the Planning Commission held a duly noticed public <br />hearing on CUP No. 2022-06. <br />E. The Planning Commission determines that the following findings, which <br />must be established in order to grant a CUP pursuant to SAMC Section 41- <br />638, have been established for CUP No. 2022-06 to allow the construction <br />of an accessory structure exceeding fifteen feet in height at 2221 North <br />Heliotrope Drive. <br />1. That the proposed use will provide a service or facility which will <br />contribute to the general well being of the neighborhood or <br />community. <br />The proposed structure, a freestanding pavilion in the rear <br />yard area designed in the traditional Vietnamese style, would <br />have minimal impacts to surrounding areas and would provide <br />a positive contribution to the neighborhood character and <br />identity.
