Debarment <br />Subrecipient shall execute and abide by the Certification Regarding Debarment, Suspension, Ineligibility <br />and Voluntary Exclusion Lower Tier Covered Transactions, attached hereto and incorporated herein by <br />this reference, and by so doing declares that it is not debarred or suspended or otherwise excluded from or <br />ineligible for participation in Federal/State assistance programs in accordance with 29 C.F.R. Part 98. <br />2. Lobbying Certification <br />A. Subrecipient shall execute and abide by the terms of the “Certification Regarding Lobbying,” <br />which is incorporated herein by this reference. Subrecipient shall complete and immediately <br />forward to the County’s Project Manager the Disclosure of Lobbying Activities, a copy of which <br />is attached hereto and incorporated herein by this reference, if Subrecipient, or any person, firm <br />or corporation acting on Subrecipient’s behalf, engaged or engages in lobbying any federal office, <br />employee, elected official or agency with respect to this Contract or funds to be received by <br />Subrecipient pursuant to this Contract. <br />B. Subrecipient agrees that the funds provided herein shall not be used to promote, directly or <br />indirectly, any political party, political candidate or political activity, except as permitted by law. <br />C. Subrecipient shall be in compliance with the Byrd Anti-Lobbying Amendment (31 U.S.C. 1352 <br />and 29 CFR Part 93). <br />3. Fraud <br />Subrecipient shall immediately report to the County’s Project Manager, in writing, all suspected, alleged, <br />or known instances and facts concerning possible fraud, abuse or criminal activity by either Subrecipient <br />or its Subcontractor(s) under this Contract. Subrecipient shall inform staff and the general public of how <br />to report fraud, waste or abuse through appropriate postings of incident reporting notice. The County’s <br />Anti-Fraud Program can be accessed https://www.ocgov.com/how-do-i/report/fraud-waste-abuse. <br />Subrecipient shall maintain records, documents, or other evidence of fraud and abuse until otherwise <br />notified by County. <br />4. Fiscal Appropriations <br />This Contract is subject to and contingent upon available local, state, and/or federal funds and applicable <br />budgetary appropriations being approved by the County of Orange Board of Supervisors for each fiscal <br />year during the term of this Contract. If such appropriations are not approved, the Contract will be <br />terminated, without penalty to the County. <br /> <br /> <br />EXHIBIT 1
