<br />pursuant to the Regulation of the Department of Health and Human Services (45 CFR Part 80) issued
<br />pursuant to that title, to the end that, in accordance with Title VI of the Act and the Regulation, no person
<br />in the United States shall, on the ground of race, color, or national origin, be excluded from participation
<br />in, be denied the benefits of, or be otherwise subjected to discrimination under any program or activity for
<br />which funds are made available under this Contract. Subrecipient hereby gives assurance that it will
<br />immediately take any measures necessary to effectuate this Contract.
<br />
<br />C. Title VII of Civil Rights Act. Subrecipient shall comply with Title VII of the Civil Rights Act of 1964
<br />(42 U.S.C. 2000), as amended by the Equal Opportunity Act of March 24, 1972 (Public Law No. 92 261),
<br />and with all applicable rules, regulations and orders promulgated pursuant thereto, as now in existence or
<br />as hereafter amended.
<br />
<br />D. Disability discrimination. Subrecipient shall comply with Sections 503 and 504 of the Rehabilitation
<br />Act of 1973, as amended (29 U.S.C. 794), the Americans with Disabilities Act of 1990 (42 U.S.C. 12101
<br />et seq.), and all requirements imposed by the applicable regulations and guidelines issued pursuant to
<br />those statutes, including 45 CFR, Part 84.
<br />
<br />E. Addition and future laws. Other current and future federal and state laws prohibiting discrimination on
<br />the basis of sex, race, color, religion, ancestry, national origin, ethnic group identification, age, mental
<br />disability, physical disability, medical condition, genetic information, marital status, or sexual orientation.
<br />
<br />F. Failure to comply. If Subrecipient fails to comply with the requirements of any Sub-Paragraphs of this
<br />Non-Discrimination and Compliance Provisions paragraph, Administrator may withhold payment to
<br />Subrecipient and/or terminate this Contract in accordance with the Termination paragraph.
<br />
<br />14. Publication
<br />No copies of sketches, schedules, written documents, computer based data, photographs, maps or graphs,
<br />including graphic art work, resulting from performance or prepared in connection with this Contract, are
<br />to be released by Subrecipient and/or anyone acting under the supervision of Subrecipient to any person,
<br />partnership, company, corporation, or department, without prior written approval by the County, except as
<br />necessary for the performance of the services of this Contract. All press releases, including graphic
<br />display information to be published in newspapers, magazines, or other media of any kind, are to be
<br />administered only by the County unless otherwise agreed to by both Parties. Nothing herein shall limit
<br />Subrecipient’s ability to comply with the CPRA, etc., in compliance with the requirements set forth in
<br />Confidentiality paragraph of this Contract.
<br />
<br />15. Drug Free Workplace
<br />Subrecipient hereby certifies compliance with Government Code Section 8355 in matters relating to
<br />providing a drug-free workplace. Subrecipient will:
<br />
<br />A. Publish a statement notifying employees that unlawful manufacture, distribution, dispensation,
<br />possession, or use of a controlled substance is prohibited and specifying actions to be taken against
<br />employees for violations, as required by Government Code Section 8355(a)(1).
