Budget Schedule <br />Subrecipient agrees that the expenditures of any and all funds under this Contract will be in accordance <br />with the Budget Schedule Attachment, which by this reference is incorporated herein and made a part <br />hereof as if fully set forth. Subrecipient shall ensure all costs incurred under the Contract, and its <br />performance hereunder, shall comply with all applicable laws, regulations, and requirements set forth in <br />Compliance with Law – Contract paragraph of this Contract. <br /> <br />11. Modification of Budget Schedule <br />Upon written approval from the Administrator the Contract Administrator shall have the authority to <br />transfer allocated program funds from one category of the overall program Budget Schedule to any other <br />category of the overall Budget Schedule pursuant to a written request submitted by Subrecipient. No such <br />transfer may be made without the express prior written approval of County. Subrecipients will be limited <br />to three (3) adjustments per year. Each modification shall be submitted to the County’s Project Manager <br />using the Budget Modification forms provided by the Contract Administrator, no later than ten (10) days <br />after the end of the first three quarters of the fiscal year as necessary. The County has the right but not the <br />obligation to make changes to the Budget Schedule at any time. County initiated adjustments will not <br />count towards the three allowed modifications each year. <br /> <br />12. Annual Audit <br />Subrecipient shall arrange for an independent audit to be performed by a Certified Public Accountant, for <br />funds received from County, in accordance with Audit Requirements detailed in the Scope of Services. <br /> <br />13. Non-Discrimination and Compliance Provisions <br />A. State laws. <br />i. Subrecipient shall, unless exempted, ensure compliance with the requirements of Cal. Gov. Code <br />§ 11135 et seq., and 2 CCR § 11140 et seq., which prohibit recipients of state financial assistance <br />from discriminating against persons based on race, national origin, ethnic group identification, <br />religion, age, sex, sexual orientation, color, or disability. <br /> <br />ii. Subrecipient’s signature affixed hereon shall constitute a certification, under penalty of perjury <br />under the laws of the State of California, that Subrecipient has, unless exempted, complied with the <br />nondiscrimination program requirements of Government Code Section 12900 (a-f) and Title 2, <br />California Code of Regulations, Section 8103. <br /> <br />iii. Subrecipient shall include the nondiscrimination and compliance provisions of this Non- <br />Discrimination and Compliance Provisions paragraph “A” in all sub-contracts to perform work <br />under this Contract. <br />B. Title VI of Civil Rights Act. Subrecipient hereby agrees that it will comply with Title VI of the Civil <br />Rights Act of 1964 [42 USC 2000d; 45 CFR 80](P.L. 88-352) and all requirements imposed by or <br />EXHIBIT 1
