cc: County Recorder <br />cc: County Surveypr <br /> c: Pub Wks, Schick - Planning <br /> <br />RESOLUTION ~O. 60-2-ll O~ERI~G THE VACATION OF <br />A PUBLIC SERVICE T~ASF~iEN'i1 RUi~/.I~I~G NORTH ~RO~ <br /> <br /> ~EREAS, on September 19, 1960, the City Council adopted <br />Resolution No. 60-179 declaring its intention to vacate a public <br />service easement for a sewer line, Cnich said kesolution describing <br />the easemen~ was published and posted as required by law; and <br /> <br /> WHEREAS, a public hearing was duly held on November 7, 1960, <br />~upon due notice in said Resolution and said posted notices contained. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br />City of Santa Ana hereby finds from all the evidence submitted that <br />the public service easement herein described is unnecessary for <br />present or prospective sewer line purposes or other public purposes <br />for the reason that said easement and contained sewer line existed <br />in the middle of private property and under two buildings, and <br />property owner has deeded to the City a substitute public sewer <br />easement along the Westerly boundary line of said property as an en- <br />largement of the existing storm drain easement and has caused the <br />construction of a new sanitary sewer connected into the East and <br />West sewers in the Second, Third and Fourth Street alignments, so <br />that said sewer easement is no longer necessary for its original <br />purpose and its use has been discontinued for approximately three <br />months. <br /> <br /> That for these reasons and primarily because said easement <br />and the sewer line have been replaced by a now existing in-use <br />sewer, said City Council hereby makes its order vacating and aban- <br />doning said public service easement for sewer line and such other <br />purposes as the substitute easement shall serve, and said easement <br />is in the City of Santa Ana, County of Orange, State of California, <br />and described as: <br /> <br /> A strip of land 14 feet in width, being 7 feet on each <br /> side, measured at right angles from the following described <br /> line: <br /> <br />-1- <br /> <br /> <br />
